Taking care of grandchild for 5 years, grandmother demands fee of 26,000 USD

China A woman in Sichuan province is suing her daughter and son-in-law, demanding $26,000 for taking care of their son for five years.

A woman surnamed Duan in Guang'an city, Sichuan province, southwest China, filed a lawsuit demanding that her daughter, surnamed Hu, and son-in-law, surnamed Zhu, pay 192,000 yuan (US$26,000) in care fees, SCMP reported on October 5.

Hu and his wife both work in Chengdu and have no time to take care of their child, so they left the child with his grandmother from February 2018 to July this year. The couple gives her 1,000 yuan (US$135) in child support and 2,000 yuan (US$270) in childcare fees each month.

Ms. Duan took care of the boy for five years without complaint. However, in July, she felt that her efforts were not being properly rewarded and asked her daughter and her husband to pay her 192,000 yuan (more than 26,000 USD).

Hu thought her mother was asking for too much money, so she negotiated and signed an agreement to pay Duan 50,000 yuan (US$6,800) without consulting her husband. Duan often urged her daughter to pay her, but Hu never paid in full. She decided to sue her daughter and her husband.

The court found that Ms. Duan had no legal obligation to raise her grandson and deserved child support. However, it also found the amount she requested was too high, so it reduced it to 82,500 yuan ($11,300).

According to Zhu, his mother-in-law decided to sue for child support because he and his wife were about to divorce. "The person she wanted to sue was me," he said.

On Chinese social media, many people said Ms. Duan did the right thing. “The compensation she asked for is reasonable,” one person commented. “She is very wise. Her purpose was to protect and fight for her daughter,” another said.

Stories of family money disputes are a regular topic of discussion online in China. In February, a lottery winner in eastern China who tried to hide 10 million yuan ($1.4 million) in winnings from his wife was ordered by a court to pay her millions of yuan in compensation.

Last September, a 29-year-old woman in southern China was sued by her parents simply because she refused to buy an apartment for her younger brother.
