Binh Dinh temporarily suspends the transfer of land use rights for land lots that investors have not yet transferred to people in urban development investment projects in Sub-areas 2, 4, 9, Nhon Hoi Economic Zone.

Binh Dinh Provincial People's Committee has just announced the concluding opinion of Mr. Nguyen Tu Cong Hoang, Vice Chairman of the Provincial People's Committee, on a number of issues related to the implementation of Urban Development Investment Projects in Sub-areas 2, 4, 9, Nhon Hoi Economic Zone.

Binh Dinh Provincial People's Committee assessed that, in recent times, along with the development of urban projects in Nhon Hoi Economic Zone, investors of Urban Development Investment Projects in Sub-areas 2, 4, 9 have tried and made efforts to implement the projects.

“However, there are still some problems, the technical infrastructure system has not been fully implemented, the coordination in handling and resolving problems is still slow, affecting the rights of the people and the investment environment of the province,” said the People's Committee of Binh Dinh province.

To overcome the shortcomings, the People's Committee of Binh Dinh province agreed with the proposal of the Economic Zone Management Board to temporarily suspend the transfer of land use rights for the land lots that the investor has not yet transferred to the people in the above projects until the investor has completely resolved the shortcomings related to the project.

Including, synchronously completing technical infrastructure works; completing and thoroughly handling tax obligations as required by the Civil Judgment Enforcement Office of District 1, Tax Office of District 1, Ho Chi Minh City; declaring and fully fulfilling financial obligations regarding payment of house and land registration fees according to the instructions of the Binh Dinh Provincial Tax Department, Binh Dinh Provincial Land Registration Office...

The People's Committee of Binh Dinh province requested that after the project investor overcomes the above-mentioned problems, the departments and branches in the province report to the competent authority to consider continuing to transfer the right to use land with invested infrastructure to people to build their own houses.

For Phat Dat Real Estate Development Joint Stock Company (investor) and Danh Khoi Holdings Investment Joint Stock Company (transferee of land lots in 3 projects), the People's Committee of Binh Dinh province requested to urgently complete the electricity and water works in Sub-areas No. 2, 4, 9 in November 2024; synchronously complete technical infrastructure works according to approved planning, repair, maintain and preserve degraded and damaged works and construction items with completion time before June 30, 2025.

The investor urgently completes the Feasibility Study Report of the remaining items of the project, submits it to the Ministry of Construction for appraisal according to regulations (time to complete all procedural documents to implement construction before June 30, 2025); completes related procedures for investment in construction of the Green Valley Area in 2024 and organizes implementation in February 2025.

Enterprises are also required to fully perform their financial obligations for the project in Sub-area No. 9; declare, fully fulfill financial obligations, and pay house and land registration fees according to the instructions of the Provincial Tax Department and the Provincial Land Registration Office in 2024.

“Coordinate with the Economic Zone Management Board to work specifically with the Department of Natural Resources and Environment and the Provincial Land Registration Office to receive guidance on completing procedures to qualify for transferring land use rights to people, and have solutions to carry out the issuance of Land Use Rights Certificates to households according to the 2023 Real Estate Business Law and the 2024 Land Law, with the time to complete the procedures in 2024,” the Vice Chairman of Binh Dinh Province requested.

In particular, the People's Committee of Binh Dinh province requested to complete the issuance of land use right certificates to eligible households in the first quarter of 2025.

Regarding the issuance of land use right certificates to households, the Vice Chairman of Binh Dinh province assigned the Department of Natural Resources and Environment to review and consider the issuance of land use right certificates to eligible households in cases where transfer contracts were signed before May 22, 2024 (the date the Civil Judgment Enforcement Office of District 1 and Tax Office of District 1, Ho Chi Minh City issued the document) to ensure people's rights; for cases from May 22, 2024 onwards, review specifically to implement when ensuring sufficient conditions according to regulations.
