On July 1, 2023, the Minister of Public Security issued Circular 24/2023/TT-BCA regulating the issuance and revocation of registration and license plates of motor vehicles.
1. Is it necessary to change the current license plate to an identification license plate?
Accordingly, Clauses 1, 2 and 4, Article 39 of Circular 24/2023/TT-BCA stipulate the transitional provisions as follows:
- For vehicles registered with 5-digit license plates before August 15, 2023 but have not completed the revocation procedure, that license plate number will be determined as the vehicle owner's identification license plate number.
- For vehicles registered with 5-digit license plates, if the vehicle owner has completed the revocation procedure before August 15, 2023, the license plate number will be transferred to the license plate warehouse to issue a new license plate according to regulations.
- Vehicles that have been registered with 3 or 4-digit license plates are allowed to continue participating in traffic, except in cases where the vehicle owner needs to change to an identification license plate or when the vehicle owner carries out procedures to issue and change vehicle registration certificates, issue and change license plates, reissue vehicle registration certificates, reissue license plates or register to transfer ownership or move the vehicle according to the provisions of Circular 24/2023/TT-BCA to revoke those 3 or 4-digit license plates and change to an identification license plate according to regulations.
Thus, according to the above regulations, 5-digit license plates issued before August 15, 2023 that have not yet completed the revocation procedure will be determined as the vehicle owner's identification license plate; if the revocation procedure has been completed before August 15, 2023, that license plate number will be transferred to the license plate warehouse to issue license plates according to regulations.
In case the vehicle has been registered with a 3 or 4-digit license plate, it will continue to be allowed to participate in traffic and will only be changed to a new identification license plate if it falls into one of the following cases:
- Vehicle owners need to transfer identification number plates;
- When the vehicle owner carries out the procedures for issuing and changing the vehicle registration certificate, issuing and changing the license plate, re-issuing the vehicle registration certificate, re-issuing the license plate or registering a name change or moving the vehicle according to the provisions of Circular 24/2023/TT-BCA, the 3 or 4-digit license plate will be revoked and replaced with an identification license plate.
2. Vehicle registration procedures according to Circular 24/2023/TT-BCA
Vehicle registration procedures according to Article 28 of Circular 24/2023/TT-BCA are as follows:
- Organizations and individuals who win the auction for car license plates must register their vehicles as follows:
+ Declare vehicle registration according to regulations in Article 9 of Circular 24/2023/TT-BCA;
+ Bring the vehicle to the Traffic Police Department where the headquarters or residence is located or the Traffic Police Department where the auctioned vehicle license plate is managed to check the vehicle; provide the online vehicle registration file code and submit the vehicle file according to the provisions of Article 27 of Circular 24/2023/TT-BCA;
+ After the vehicle registration officer checks the vehicle records and the vehicle is actually valid, the vehicle registration agency will issue a license plate for the auctioned vehicle; receive an appointment to receive the vehicle registration results, and pay the vehicle registration fee according to regulations; in case the vehicle owner wants to receive the vehicle registration results via the public postal service, he/she must register with the public postal service unit;
+ Receive vehicle registration results at the vehicle registration office or from a public postal service unit.
- In case of transferring vehicle ownership without accompanying license plate of auction winning vehicle
+ Vehicle owners submit documents and carry out recall procedures according to regulations in Clause 1, Article 14, Clause 1, Article 15, Circular 24/2023/TT-BCA;
+ Organizations and individuals receiving vehicle ownership transfer must submit documents and complete vehicle registration procedures according to regulations in Clause 2, Article 14, Clause 2, Article 15 of Circular 24/2023/TT-BCA.
- In case of transferring vehicle ownership with the license plate of the auctioned vehicle:
+ The vehicle owner submits the application and completes the revocation procedures according to the provisions of Clause 1, Article 14, Clause 1, Article 15 of Circular 24/2023/TT-BCA. The vehicle owner does not have to return the auction-winning license plate but must submit a copy of the vehicle ownership transfer document and present the original for comparison (the ownership transfer document must clearly show the content of the vehicle ownership transfer along with the auction-winning license plate);
+ Organizations and individuals receiving vehicle ownership transfer must submit documents and complete vehicle registration procedures according to regulations in Clause 2, Article 14, Clause 2, Article 15 of Circular 24/2023/TT-BCA and be able to register and keep the license plate of the auction-winning vehicle (the ownership transfer document must clearly show the content of the vehicle ownership transfer along with the auction-winning license plate).
Organizations and individuals who have received the transfer of vehicle ownership and the winning license plate of the auctioned vehicle are not allowed to continue transferring the vehicle ownership and the winning license plate to other organizations and individuals; they are allowed to transfer vehicle ownership according to the provisions of law.
