General Phan Van Giang: Drones pose many potential risks

On the afternoon of June 19, General Phan Van Giang, Minister of National Defense, presented a report on the draft Law on People's Air Defense. According to Minister Phan Van Giang, today, in modern warfare, air attack and air attack prevention plans have become extremely important requirements, deciding the success or failure of the battlefield situation. In many countries around the world, the work of managing and protecting airspace at altitudes below 5,000m is being highly valued by many countries around the world, especially at the present stage where unmanned aircraft are being researched, manufactured, exploited, and used for military purposes as a new combat force bringing high combat effectiveness.

The Minister of National Defense stated that the illegal use of drones and ultralight aircraft is increasing, posing many potential threats to national defense, security, safety and aviation security. Meanwhile, the National Defense Law and legal documents related to the task of people's air defense, management of drones and ultralight aircraft only provide a framework and are principled. Therefore, the development and promulgation of the Law on People's Air Defense is very necessary. The draft Law on People's Air Defense submitted to the National Assembly has 8 chapters, with 54 articles. In addition to general provisions on the development and mobilization of people's air defense forces, the draft devotes 9 articles (from article 27 to article 36) to regulating the management of drones and ultralight aircraft and ensuring air defense safety. In Article 29, the draft law stipulates: Unmanned aircraft and ultralight aircraft must be registered and managed by competent authorities according to the provisions of law before being put into operation and use. The Ministry of Public Security is responsible for registering unmanned aircraft and ultralight aircraft of agencies, organizations and individuals, except for unmanned aircraft and ultralight aircraft managed by the Ministry of National Defense. The public security agency shall provide information on registration of unmanned aircraft and ultralight aircraft associated with the owners of the aircraft to the Ministry of National Defense for coordinated management. The draft law stipulates four cases of temporary detention, seizure and control of unmanned aircraft and ultralight aircraft. The Government will prescribe the order and procedures for temporary detention, seizure and control of unmanned aircraft and ultralight aircraft.

"The majority of members of the National Defense and Security Committee basically agreed to the provisions as in the draft law," Chairman Le Tan Toi reported to the National Assembly . There are opinions in the examining body that the provisions on the authority to temporarily detain, seize, and suppress unmanned aircraft and ultralight aircraft can easily lead to overlapping of authority, especially the authority of the Commander of the Military Region and the Commander of the Military Command at all levels. Because the above subjects all have authority in the same area without distinguishing the subject of the first detection or the nature of the violation as a basis for determining authority, it is necessary to continue research to determine authority appropriately. These opinions suggest decentralizing the handling to the commune level and establishing a People's Air Defense Steering Committee at the commune level to handle quickly and effectively from the grassroots level.
