Speed ​​up the handover of national highways to local management

The Ministry of Transport requested to speed up the progress of decentralization of national highway management according to the provisions of the 2024 Road Law.

The Ministry of Transport has just sent a document to the People's Committees of provinces and cities; the Vietnam Road Administration requests to deploy practical work to speed up the progress of decentralizing national highway management to the People's Committees of provinces and cities.

Accordingly, the Ministry of Transport requested the People's Committees of provinces and cities to issue documents assigning specialized agencies of transport under their management (Departments of Transport) to, on behalf of the provincial People's Committees, coordinate with the Vietnam Road Administration to review and count, on that basis, draw up a unified record on the list, length, and route of national highways in the area.

Review works and construction items of road infrastructure associated with decentralized national highways such as road management offices, vehicle load control works, road land, road safety corridors and other items.

On that basis, it is recommended that the Provincial People's Committee send a document to the Ministry of Transport on the decentralization and handover of management of national highways, service roads, and side roads separated from national highways in the area so that the Ministry of Transport can carry out procedures according to regulations.

Regarding national highways passing through special urban areas such as Hanoi and Ho Chi Minh City, the Ministry of Transport requested the People's Committees of these two cities to give their opinions on the time of handing over national highway and expressway sections passing through special urban areas.

In particular, it is noted that the management of national highway sections and expressway sections assigned by enterprises to invest in construction, management, operation and exploitation by the State must comply with legal regulations.

The Ministry of Transport also assigned the Vietnam Road Administration to direct and urge the Road Management Areas to coordinate with the Departments of Transport to promptly implement. If necessary, the Vietnam Road Administration will proactively coordinate with the Provincial People's Committee to complete the procedures for decentralization and handover of management of national highways, service roads, and side roads separated from national highways according to regulations.

Regarding this issue, the Vietnam Road Administration said that the unit has deployed preparations to ensure the implementation of decentralization of national highway management immediately after the Decree implementing the Road Law takes effect.

It is expected that after decentralization, the Ministry of Transport will only directly manage about 3,650km of national highways and expressways, accounting for about 16% of the total length of national highways; decentralizing to the Provincial People's Committees to manage about 19,000km, accounting for about 84% of the total length of national highways.

Decree 165/2024 guiding a number of articles of the Road Law and Article 77 of the Law on Road Traffic Order and Safety, effective from January 1, 2025, stipulates: Decentralization of management of national highways in provinces and centrally run cities to the Provincial People's Committee; works and items of road infrastructure associated with decentralized national highways; bridge, tunnel and ferry works located in two provinces and centrally run cities.

Unclassified national highways, including: Expressways managed by the Ministry of Transport; National Highway 1, Ho Chi Minh Road to connect national highways and other roads along the length of the country; national highways with special requirements for ensuring national defense and security; national highway routes and sections that the State has assigned state-owned enterprises to invest in construction, management, operation, exploitation, and maintenance; other cases decided by the Prime Minister.

After decentralization, the Government assigns the provincial People's Committees the responsibility to invest in and construct national highways according to the approved road network and road infrastructure planning; manage, operate, exploit, maintain, and protect the road infrastructure of the decentralized national highways.
