Regarding the draft revised Law on Employment that is being consulted by the Ministry of Labor, War Invalids and Social Affairs , the drafting agency proposed to change some groups that do not have to participate in unemployment insurance.
Accordingly, the draft adds groups that do not have to participate in unemployment insurance, including: Employees working under probationary contracts; people who have retired and received pensions, social insurance benefits, and monthly allowances; people who are eligible for pensions but have not yet received them; and domestic workers.
Meanwhile, the current Employment Law stipulates that those who do not have to participate in unemployment insurance are pensioners and domestic workers.
In addition, the draft Law also adds a number of groups participating in unemployment insurance, including: Employees with a labor contract with a term of 1 month or more; part-time workers, with a total monthly salary equal to or higher than the salary used as the basis for compulsory social insurance payment, at least equal to half of the minimum monthly salary in the highest region announced by the Government .

Another group includes business managers, controllers, representatives of state capital, representatives of enterprise capital at the company and parent company, managers and executives of cooperatives and cooperative unions who receive salaries.
In order to contribute to expanding the number of participants in unemployment insurance, in this amendment, the drafting agency has proposed additional benefits for unemployed workers.
According to Clause 1, Article 96 of the draft Law, the unemployment insurance regimes proposed by the Ministry of Labor, War Invalids and Social Affairs have been supplemented with 2 regimes compared to current regulations.
That is, supporting workers to participate in training, improving vocational skills and assessing and granting national vocational skills certificates; supporting employers when employing disabled workers.
Thus, if the draft is passed, unemployed workers will enjoy 5 unemployment insurance regimes, including 3 current regimes, 2 new regimes added, and 1 regime removed from the current one.
Accordingly, unemployment insurance regimes include: Unemployment benefits; support for job counseling and referral; support for employers in training and improving vocational skills to maintain employment for employees.
Support workers in participating in training, improving vocational skills and assessing and granting national vocational skills certificates; support employers when employing disabled workers.
Based on the balance of the Unemployment Insurance Fund, the Government shall prescribe cash support, unemployment insurance contribution support and other support in case of economic crisis or recession, natural disaster, fire, war or dangerous epidemic.
Compared to the current Law on Employment, the draft Law has removed the vocational training support regime. In fact, this policy has not attracted a large number of workers to participate in recent years.
According to statistics from the Ministry of Labor, War Invalids and Social Affairs, as of the end of March, the number of people participating in unemployment insurance is estimated at 14.244 million people, an increase of 1.67% over the same period in 2023.
In April 2024, the whole country had 48,821 people with decisions to receive unemployment benefits, down 19.1% over the same period in 2023. In the first 4 months of the year, there were more than 208,000 people enjoying this regime, down 9% over the same period in 2023.
