Proposed new regulations on the number of deputy members of People's Councils at all levels

On the afternoon of September 29, Deputy Minister of Justice Dang Hoang Oanh chaired a meeting of the Council to review the draft Resolution of the National Assembly Standing Committee on the number of Vice Chairmen of the People's Council (PC), Vice Heads of the People's Council at the provincial and communal levels and the arrangement of full-time People's Council delegates.

Presenting the Report at the meeting, Mr. Phan Trung Tuan, Director of the Department of Local Government, Ministry of Home Affairs , said that the issuance of the Resolution aims to concretize the 2013 Constitution (amended and supplemented by a number of articles in Resolution No. 203/2025/QH15) and the Law on Organization of Local Government No. 72/2025/QH15; improve the efficiency, effectiveness and efficiency of the People's Councils at the provincial and communal levels in the context of implementing the 2-level local government model and strengthening decentralization and delegation to local governments at all levels.

Regarding the basic content of the Resolution, Mr. Phan Trung Tuan said that the number of Vice Chairmen of the Provincial People's Council is regulated as follows: Localities that merge 3 provincial-level administrative units (PPUs) have no more than 4 Vice Chairmen of the People's Council; localities that merge 2 provincial-level PPUs have no more than 3 Vice Chairmen of the People's Council; localities that do not merge have no more than 2 Vice Chairmen of the People's Council. In case the Provincial People's Council Chairman is a full-time People's Council delegate, the number of Vice Chairmen of the Provincial People's Council is reduced by 1 person.

Regarding the number of Deputy Heads of the Provincial People's Council, localities that merge or consolidate 3 provincial-level administrative units have no more than 4 Deputy Heads of the Committee; localities that merge or consolidate 2 provincial-level administrative units have no more than 3 Deputy Heads of the Committee. For localities that do not merge or consolidate, each Committee has no more than 2 Deputy Heads of the Committee. In case the Head of the Provincial People's Council is a full-time People's Council delegate, the number of Deputy Heads of the Committee is reduced by 1 person.

Regarding the number of full-time members of the Provincial People's Council Committees, it is stipulated that each Committee shall have no more than one member who is a full-time People's Council delegate. The number of Vice Chairmen of the People's Council, Vice Heads of Committees of the People's Council and members of Committees of the Hanoi People's Council who are full-time People's Council delegates shall comply with the provisions of the Law on the Capital.

Regarding the number of Vice Chairmen and Vice Heads of the People's Council at the commune level, the draft Resolution stipulates that the commune level has 1 Vice Chairman of the People's Council. Each Committee of the People's Council at the commune level is calculated on average to have 2 Vice Heads of the Committee. Based on the scale of natural area, population, classification of administrative units, classification of urban areas, economic scale, practical situation of the locality and orientation of the Standing Committee of the Provincial Party Committee, City Party Committee, the Standing Committee of the People's Council at the provincial level decides specifically the number of Vice Heads of the People's Council at each administrative unit at the commune level to ensure that the total number of Vice Heads of the People's Council at the commune level of the province or city does not exceed the total number calculated according to the average framework prescribed above.

At the meeting, opinions in the Appraisal Council expressed consensus on the political and legal basis for the development of the Resolution. Delegates agreed with the issuance of the Resolution to create a synchronous and unified legal basis for the organization and operation of the People's Councils at the provincial and communal levels when operating the two-level local government in accordance with the provisions of the Constitution and the Law on Organization of Local Government; meeting the requirements for arranging the number of full-time People's Council delegates at the provincial and communal levels to ensure compliance with the policy of promoting decentralization and decentralization and local practical situations, contributing to improving the effectiveness and efficiency of the People's Councils at all levels in the new development period.

Concluding the meeting, Deputy Minister of Justice Dang Hoang Oanh, Chairman of the Appraisal Council, said that the contents of the draft Resolution ensure constitutionality, legality, compatibility with relevant international treaties to which Vietnam is a member, ensuring national defense, security, and requirements on financial resources, human resources, etc.

Deputy Minister Dang Hoang Oanh requested the Drafting Agency to continue reviewing the provisions on decentralization in the draft Resolution to ensure compliance with the principles and regulations on decentralization and delegation of power in the Law on Government Organization and the Law on Organization of Local Government. Along with that, it is necessary to review the provisions in the main content groups of the draft Law and the scope of regulation to ensure specificity and logic.

Agreeing with the drafting of the Resolution following the simplified procedure, the Deputy Minister requested the drafting agency to review and complete the draft Resolution dossier to ensure compliance with the provisions of the Law on Promulgation of Legal Documents. The draft Resolution is eligible to be submitted to the Government after receiving comments from members of the Appraisal Council.

Also on the afternoon of September 29, Deputy Minister Dang Hoang Oanh chaired a meeting of the Council for Appraisal of the draft Resolution of the National Assembly Standing Committee stipulating standards and conditions for establishing the Ethnic Committee of the People's Council at the provincial level. The draft Resolution supplements standards and conditions for establishing the Ethnic Committee of the People's Council of centrally-run cities; removes regulations on establishing the Ethnic Committee of the People's Council at the district level. At the same time, it inherits the standards prescribed in Resolution No. 1130/2016/UBTVQH13 because these standards are still suitable for practice and provincial-level administrative units have established Ethnic Committees in the new situation.
