Reasons for not expanding the scope of military deferment for citizens who graduated from college or university

The Ministry of National Defense believes that expanding the scope of military service deferment to citizens who have graduated from college or university and continue to study for master's or doctoral degrees is not suitable for the current situation and causes social injustice.

The National Assembly's Committee for Petitions and Supervision has forwarded to the Ministry of National Defense a petition from Quang Binh voters regarding the age of military service for college, university, and postgraduate students.

Accordingly, voters believe that the regulation in Article 30 of the 2015 Law on Military Service: "... citizens with college or university degrees who have been temporarily deferred from military service, the age for military service is up to 27 years old" is not really suitable for reality and lacks flexibility.

Voters analyzed: "Under normal conditions, currently, college and university students graduate at 22 years old. If they continue to study for a master's degree, they will graduate at 24 years old; if they continue to do research, they will receive a doctorate at 26 years old. According to regulations, after graduating from college, university or master's, research students and students must perform military service because they are not yet 27 years old.

The problem is that most students when participating in studying and training at colleges, universities or postgraduate training facilities are in difficult circumstances; many students, especially those in rural areas, have to borrow money to go to school, but when they graduate, they have to join the military immediately, making the difficulties even more difficult, and it is unknown when they will be able to pay off the loans they invest in for their studies.

For the above reasons, voters proposed to study and submit to the National Assembly for more flexible regulations on the age of military service for cases of military service postponement due to college, university, and postgraduate training to create conditions for them to have job opportunities to soon have income and pay off investment loans for the learning process.

The appropriate age for military service is up to 27 years old.

Responding to voters, the Ministry of National Defense said that, based on Article 30 of the 2015 Law on Military Service, which stipulates the age of military service; Point g, Clause 1, Article 41; Point k, Clause 1, Article 50, which stipulates the regime and policies for non-commissioned officers and soldiers during their military service, "the repayment of loans from social policy banks, which are temporarily deferred and not subject to interest, and which, before enlisting, were members of poor households, students, and pupils according to the provisions of law, are temporarily deferred and not charged interest on loans from social policy banks."

To ensure social justice, citizens who have graduated from college or university and have been temporarily deferred from military service will be called up to 27 years old. This regulation is in line with the social life and aspirations of the people in the current period.

At the same time, it meets the legitimate aspirations of the right to study and work according to the provisions of law; both creating high-quality human resources necessary for the cause of industrialization and modernization to develop the country, and ensuring sufficient quantity and quality of citizens joining the army.

"Currently, the average number of citizens who are temporarily deferred from military service nationwide is more than 55%, and in Quang Binh province alone it is 64% compared to the total number of young people of military age. Therefore, if we expand the deferred status to citizens who have graduated from college or university and continue to study for master's or doctoral degrees, it is not suitable for the current situation and causes social injustice," the Ministry of National Defense emphasized.

The Ministry of National Defense will direct competent agencies to conduct comprehensive research and propose to the National Assembly and the Government to consider amending and supplementing the 2015 Law on Military Service and related legal documents at an appropriate time when there is sufficient political, legal and practical basis...

For now, only amend and supplement issues related to the implementation of two-level local government.
