Duties and powers of the Department of Education and Training, Department of Culture and Social Affairs under the People's Committee at the commune level

The Ministry of Education and Training issued Circular No. 15/2025/TT-BGDDT guiding the functions, tasks and powers of the Department of Education and Training under the People's Committees of provinces and centrally run cities and the Department of Culture and Social Affairs under the People's Committees of communes, wards and special zones under provinces and centrally run cities in the field of education and training.

According to this Circular, the Department of Education and Training is a specialized agency under the Provincial People's Committee, performing the function of advising and assisting the Provincial People's Committee in state management of: Preschool education ; general education; vocational education, continuing education; university education (if any) and performing other functions as assigned, decentralized or authorized by the Provincial People's Committee, the Chairman of the Provincial People's Committee according to the provisions of law.

The Department of Education and Training has legal status, its own seal and account according to the provisions of law; complies with the direction and management of the provincial People's Committee in terms of organization, staffing and work; and is subject to the direction, guidance and inspection of the Ministry of Education and Training in terms of professional expertise.

The Department of Culture and Society advises and assists the People's Committee at the commune level in performing the state management function for: Preschool education; general education (preschools, primary schools, secondary schools, multi-level general schools with the highest level being secondary school); community learning centers.

This Circular takes effect from July 24, 2025; replaces Circular No. 12/2020/TT-BGDDT dated May 22, 2020 of the Minister of Education and Training guiding the functions, tasks and powers of the Department of Education and Training under the People's Committee of the province, centrally-run city, the Department of Education and Training under the People's Committee of the district, town, city under the province, city under the centrally-run city.

Regarding the transfer of functions and tasks between agencies related to administrative procedures, the following principles shall apply:

In case an organization or individual has submitted the application before the effective date of this Circular, it shall continue to comply with the provisions of law at the time of application submission.

Documents and papers that have been issued or granted by competent authorities or titles before the effective date of this Circular but have not expired or have not expired shall continue to be applied and used in accordance with the provisions of law until they expire or are amended, supplemented, replaced, abolished, cancelled or revoked by the authority or title receiving the functions, tasks and powers or the competent authority or person.
