Many challenges for practicing law in the current period

Chairing the National Scientific Workshop "Contributing ideas to the outline of the orientation for building the Law on Lawyers (amended)".

At the workshop, Dr. Le Truong Son - Principal of Ho Chi Minh City University of Law said that, facing many challenges facing the practice of law in the country, from the needs arising from practice, the Ministry of Justice is building an outline for the development of the Law on Lawyers (amended) to collect opinions from agencies, organizations and Bar Associations nationwide.

According to Dr. Le Truong Son, the Outline has basically provided a legal framework in many important contents to clarify the concepts and standards of lawyers. However, there are still many different opinions on the Outline and many problems and difficulties arising in the practice of law.

Regarding this issue, Lawyer Phan Trung Hoai - Vice President of the Vietnam Bar Federation said that the legal profession has differences with other professions related to law not only in its functions as assigned by society, but also in the way it is expressed through independent practice methods.

The legal profession also has a service nature - the service nature of the legal profession is a special type of service, different from the concept of normal services such as commercial services, through the legal form of service contracts.

"In theory, it is necessary to consider the legal status of lawyers in a more comprehensive and broader way than considering the role according to the function and scope of practice of lawyers," Lawyer Phan Trung Hoai suggested.

Based on the perspective of a lawyer who has worked in a number of positions in legal activities, Lawyer Nguyen The Phong has made comments on the structure of the Law on Lawyers (amended) such as: a new Law should be issued to replace the old law for convenience in legislative and regulatory techniques.

Regarding the issue of lawyer standards, this lawyer believes that the standard of "political courage" should be added to the lawyer standards, because when an individual joins the Bar Association to become a member as a Lawyer or Trainee Lawyer (as oriented), the Bar Association only needs to check the diploma, certificate and confirmation from the local government on compliance with the law, ethics and lifestyle of the place of residence is appropriate.

According to a group of experts at the Ho Chi Minh City University of Law, there are currently more than 18,200 lawyers operating in more than 5,400 law practice organizations nationwide. Therefore, amending the current Law on Lawyers in the context of law practice organizations, along with the birth of many Resolutions, Party documents, and State legal documents related to this subject is particularly urgent.

At the workshop, experts and lawyers devoted a lot of time to contributing and building their opinions with enthusiasm, raising their responsibility in amending and supplementing the Law on Lawyers. Many opinions were raised specifically and in detail to improve the effectiveness of the Lawyers' profession and were summarized by the Organizing Committee to send to the authorities.
