Permanent Vice Chairman of Hanoi City People's Council receives citizens on case-by-case basis

Kinhtedothi - On the morning of March 27, Member of the Standing Committee of the City Party Committee, Permanent Vice Chairwoman of the Hanoi People's Council Phung Thi Hong Ha received citizens on the case of citizen Dien Thi Hoa, in Group 2, Van Hoi Street, Duc Thang Ward, Bac Tu Liem District, Hanoi City.

Accordingly, citizen Dien Thi Hoa, in group 2, Van Hoi street, Duc Thang ward, Bac Tu Liem district, Hanoi city, requested to be granted a certificate of land use rights, house ownership rights and other assets attached to the land plot at residential group 2, Duc Thang ward, Bac Tu Liem district, Hanoi city.

The development of the case is as follows: the land that Ms. Dien Thi Hoa requested to be granted a certificate of land use rights at plot number 36, map sheet number 40, area ^79m2 in residential group number 2, Duc Thang ward, Bac Tu Liem district, originated from the transfer by Ms. Luu Ba Kiem to Ms. Tran Huong Giang on January 28, 1995.

On June 1, 2000, Ms. Tran Huong Giang continued to transfer the house to Ms. Dien Thi Hoa. Because Ms. Dien Thi Hoa requested to have documents from the owner from Ms. Luu Ba Kiem to Ms. Hoa for convenience of use, the People's Committee of Dong Ngac commune revoked and canceled the confirmation of the sale between Ms. Luu Ba Kiem and Ms. Tran Huong Giang on January 28, 1995 and confirmed the application for permission to sell the house on June 1, 2000 from Ms. Luu Ba Kiem transferred to Ms. Dien Thi Hoa.

On February 22, 2023, Duc Thang Ward People's Committee worked with Dong Ngac Ward People's Committee to verify the provision of documents on Dong Thang Cooperative's allocation of land for resettlement in 1985 - 1986 to Ms. Luu Ba Kiem, but there were no documents related to the allocation of land for resettlement plot 36, map sheet number 40.

According to the residential area opinion poll dated May 15, 2020, the land plot that Ms. Dien Thi Hoa is using was originally granted by the cooperative around 1985-1986 to Ms. Luu Ba Kiem. When it was granted, the cooperative did not have any documents and did not collect land use fees.

Since 2016, the receiving and returning results department of the People's Committee of Phuc Thang ward, Bac Tu Liem district has received Ms. Dien Thi Hoa's application for a land use rights certificate.

Next, in 2024, Duc Thang Ward People's Committee issued documents on supplementing the dossier for granting land use right certificate to Ms. Dien Thi Hoa, including: Document No. 426/BC-UBND dated March 28, 2024; Document No. 935/UBND-BC dated August 10, 2024.

On December 4, 2024, the Land Registration Office - Bac Tu Liem District Branch issued Document No. 2817/VPĐKĐĐHN CNQBTL regarding the review of Ms. Dien Thi Hoa's application, which stated: Hanoi Land Registration Office - Bac Tu Liem District Branch has checked the documents, confirmed the eligibility to issue a Certificate in the Application, issued a Certificate; issued Document No. 2813/VPĐKĐĐHN CNQBTL and transferred the entire application for a Certificate of Ms. Dien Thi Hoa to the District Department of Natural Resources and Environment for appraisal, and submitted to the District People's Committee to recognize land use rights according to regulations for citizens.

However, up to now, Ms. Dien Thi Hoa's application for a certificate has not been completely resolved.

At the citizen reception, the leader of Duc Thang ward, Bac Tu Liem district reported to clarify the reason why out of 6 plots of land, 5 plots of land had been granted land use right certificates before 2005, but 1 plot of land transferred by Ms. Tran Huong Giang to Ms. Dien Thi Hoa had not been granted.

At the same time, the units also clearly reported the reason that since 2016, the Department of Receiving and Returning Results of the People's Committee of Duc Thang Ward, Bac Tu Liem District has received Ms. Dien Thi Hoa's application for a certificate of land use rights. In which, the authorities all affirmed that Ms. Dien Thi Hoa's request up to now has met the conditions for granting a certificate of land use rights, however, the application needs to be supplemented.

After listening to reports from units, departments and branches and clarifying the case file, Permanent Vice Chairwoman of the City People's Council Phung Thi Hong Ha requested the professional agencies of Bac Tu Liem district to completely resolve this case in April 2025.

For citizens, the Standing Vice Chairman of the City People's Council suggested completing the dossier according to the instructions of the specialized agency to ensure sufficient conditions for granting land use right certificates.

Standing Vice Chairwoman of the City People's Council Phung Thi Hong Ha also requested the City Department of Agriculture and Environment to provide professional guidance on handling land procedures for localities, in order to ensure the rights of citizens.
