Recently, the Department of Natural Resources and Environment has paid great attention to the inspection and examination of land use of projects that have been allocated or leased land by the State. Every year, it develops and issues an inspection and examination plan and conducts surprise inspections of projects when there is public information.

Since 2023, the Department of Natural Resources and Environment has inspected 17 projects, of which 3 projects with an area of about 54.42 hectares of Hoang Khang Quang Tri One Member Co., Ltd., Loc Thien Phu Quang Tri Joint Stock Company and Quang Tri Industrial Packaging Joint Stock Company have been revoked; 2 projects with an area of 0.54 hectares have been extended according to the Land Law; 7 decisions on administrative sanctions have been issued against 5 organizations that have not completed procedures to lease land; 2 individuals were late in registering land changes, the records were discovered by the Land Registration Office with a fine of 971 million VND.
In particular, the inspection and recommendation to reclaim land of Hoang Khang Quang Tri One Member Co., Ltd. due to the company's violation of the 2013 Land Law. Hoang Khang Quang Tri One Member Co., Ltd. was assigned land by the Provincial People's Committee with land use fees to implement the project of construction, development and business of infrastructure of Dong Gio Linh Industrial Cluster with an investment of 120 billion VND.
However, after more than 10 years, the company has not yet completed the project items. The area of more than 50 hectares that the company leased is mostly empty, with a section of fence, a house and steel and concrete structures...
Due to the fact that the land use is more than 24 months behind schedule compared to the progress recorded in the investment project since the date of land handover in the field and the Provincial People's Committee has allowed the extension and delay of land use progress many times but has not complied, so through inspection, the Department of Natural Resources and Environment has proposed the Provincial People's Committee to reclaim the land. After the land area is reclaimed, the Provincial People's Committee assigned the Gio Linh District People's Committee to manage it to develop a plan and put the land into use in accordance with the planning.
In addition, the Department of Natural Resources and Environment presides over and coordinates with the Provincial Economic Zone Management Board, Gio Linh District People's Committee and relevant units to determine boundaries, organize land recovery in the field; and recover the original land use right certificate issued to the company.
The Provincial Economic Zone Management Board coordinated with the People's Committee of Gio Linh district and related units to guide the company to handle assets on land; terminate the investment project. Hoang Khang Quang Tri One Member Co., Ltd. must correct violations in illegal titanium mining; handle assets on land to hand over the land to the State.
In 2024, the Department of Natural Resources and Environment inspected 26 projects, including the revocation of 1 project with an area of about 0.23 hectares of Hoai Bao Tran LLC; extension according to the Land Law of 4 projects with an area of 33.58 hectares of Van An Agricultural Services Cooperative, Amacons Quang Tri LLC, ASIA Alloy Steel Joint Stock Company, Long Hung Thinh Quang Tri LLC; administrative sanctions against 10 cases (9 organizations; 1 individual) with a fine of 113 million VND. The acts detected through the inspection and examination of projects are mainly non-use of land; slow progress of land use; encroachment of land; improper use of land; improper leasing; slow registration of land changes.
In reality, the implementation of inspection and examination work of the Department of Natural Resources and Environment is facing some difficulties due to the small number of inspectors, which does not meet the requirements for inspection and examination work, while focusing on resolving many complaints and denunciations. Therefore, some projects are behind schedule, encroachment has not been detected in time, leading to some organizations using land ineffectively and wastefully.
On the other hand, the sanctions for recovery under the Land Law 2013, 2024 have not been regulated yet, so they cannot be handled. Due to the prolonged impact of COVID-19 causing economic difficulties, some construction projects have not been completed and are behind schedule.
Therefore, in order for the Department of Natural Resources and Environment to perform its inspection and examination tasks well, it is recommended that the Provincial People's Committee consider reclaiming land or extending the term for a number of projects that have been submitted to the Provincial People's Committee by the Department of Natural Resources and Environment.
Increase the number of inspectors in the Department of Natural Resources and Environment. Continue to strengthen the review and inspection of land-use projects; resolutely revoke projects that are behind schedule and violate land laws.
