Ho Chi Minh City will consider abolishing Decision 32 on management and temporary use of roads and sidewalks, and at the same time study a project to exploit and deploy sidewalk management software.
The Office of the Ho Chi Minh City People's Committee has just announced the conclusion of Vice Chairman of the Ho Chi Minh City People's Committee Bui Xuan Cuong on the implementation of management and temporary use of a part of the roadway and sidewalk in the city.
In particular, the City People's Committee leaders assigned the Department of Transport and Public Works (GTCC) to coordinate with the Department of Justice to review the Law on Road Traffic Order and Safety, Decree No. 165 of the Government ... to advise on the implementation of abolishing Decision No. 32 on management and temporary use of roads and sidewalks according to shortened procedures.
This content must be completed by April 15.
The Department of Transport is also assigned to coordinate with relevant departments and units to review and propose to the City People's Committee on the policy, scope, and budget for developing a project to exploit and use roads and sidewalks, to be completed before April 10; By the second quarter of 2025, the sidewalk management software from Visa Worldwide Pte.Limited will be in operation.
In addition, the Department of Transport is responsible for coordinating and urging the People's Committee of Thu Duc City and districts to effectively manage and temporarily use roads and sidewalks and speed up the implementation of projects to renovate, repair and upgrade sidewalks.
Decision 32 of the Ho Chi Minh City People's Committee issued on July 26, 2023 to replace Decision 74 of 2008 on management and use of roads and sidewalks. This decision officially takes effect from September 1, 2023 with the aim of ensuring safety, efficiency and urban beauty.
According to the new decision, the city allows cases of temporary use of sidewalks and roadsides and paying fees as places to organize business services, buy and sell goods; paid parking spots; places to organize cultural activities and keep vehicles to serve these activities; transfer points for materials and waste, etc.
The principle when temporarily using a part of the roadway or sidewalk must ensure that it does not cause disorder and traffic safety; it must not block intersections, in front of gates and within a range of 5 meters. The sidewalk must be at least 1.5 meters wide for pedestrians. If the roadway is used for other purposes than traffic, it must have at least 2 lanes for cars in one direction; special cases will be decided by the People's Committee of Ho Chi Minh City.
Decision 32 also stipulates that the temporary use of a part of the roadway or sidewalk must be licensed or approved by the competent authority as well as classified into subjects; in cases where fees must be paid according to regulations, the collection and payment of fees for temporary use of the roadway or sidewalk shall comply with the provisions of the Law on Fees and Charges and guiding documents for implementation.
As of January 1, 2024, Ho Chi Minh City has officially collected fees for temporary use of roads and sidewalks to manage urban order and generate revenue for infrastructure maintenance.
