National Assembly Standing Committee: Tighten discipline and order in law-making

Continuing the 37th Session, on the morning of September 12, the National Assembly Standing Committee gave opinions on the Government's Report on the implementation of the Constitution, laws, and resolutions of the National Assembly.

Presenting the review report, Chairman of the National Assembly's Law Committee Hoang Thanh Tung said that the Standing Committee of the Law Committee highly appreciated the efforts and determination in the direction and administration of the Government and the Prime Minister, and the serious implementation of ministries, branches and localities in the work of perfecting institutions and organizing law enforcement.

The Government has completed a large volume of basic legislative tasks to ensure progress, and there has been no withdrawal of projects already in the Law and Ordinance Development Program. The Government has strengthened the direction of the development and promulgation of documents detailing the implementation of laws, ordinances, and resolutions, and applied many new, more effective, proactive, and urgent solutions right from the stages of making a list, assigning drafting tasks, implementing them, to monitoring, urging, and inspecting.

However, the Standing Committee of the Law Committee pointed out that the number of draft laws and resolutions to be submitted at each session of the National Assembly is very large but does not ensure balance between fields; many projects are added to the Program close to the time of organizing the National Assembly session or the meeting of the National Assembly Standing Committee.

There are still contradictions, overlaps, and lack of consistency and uniformity between legal documents or unclear and specific regulations, even the same regulations can be interpreted in different ways, making it difficult to enforce the law. In addition, there are still many documents issued slowly and not ensuring simultaneous enforcement with the law.

Speaking at the session, National Assembly Chairman Tran Thanh Man noted that it is necessary to innovate the implementation and inspection of the Constitution, laws, resolutions of the National Assembly, ordinances and resolutions of the National Assembly Standing Committee in a "thorough and thorough" manner.

“Which areas are doing well, and which are not? Good areas must be recognized and rewarded promptly, and poor areas must be criticized and reviewed,” the National Assembly Chairman suggested.

According to the National Assembly Chairman, the origin of law making must come from ministries and branches. Ministers, Deputy Ministers, and relevant departments must sit in many meetings, must review each clause, each article, each chapter of the law and resolution, then the law and resolution will have quality. If the submitting agencies are thorough, when they send it to the Nationalities Council and the National Assembly Committees, they will examine the issues accurately and correctly.

The National Assembly Chairman requested that not only ministries and branches but also the Nationalities Council and the National Assembly Committees in the coming time need to be orderly, disciplined, and determined in examining draft laws to express political opinions, with the ultimate wish that "the laws and resolutions that are issued must have quality and longevity."

The National Assembly Chairman also requested the National Assembly's Law Committee and the Ministry of Justice to closely coordinate from the drafting stage to the implementation and enforcement of laws and resolutions.

Recalling Regulation No. 178-QD/TW dated June 27, 2024 of the Politburo on controlling power, preventing and combating corruption and negativity in law-making work, the National Assembly Chairman requested that each stage and each section must be done well, meeting quality requirements, not chasing quantity, and taking the legitimate and legal rights and interests of people and businesses as the focus.

“We tighten discipline and order, and are not influenced or influenced by any local interest group in law-making,” the National Assembly Chairman emphasized.

In addition, the National Assembly Chairman proposed clarifying the plan to handle the situation of slow issuance of documents detailing the implementation of the law, linking the responsibility for issuing documents with the responsibility of the heads of agencies.

Chairwoman of the National Assembly's Judiciary Committee Le Thi Nga said that the Government needs to pay attention to disseminating and educating the law according to the target groups and regions, and at the same time increase the posting of documents disseminating and educating the law on social networks so that people can promptly and quickly grasp the content of current legal documents.

Regarding the work of inspecting and reviewing legal documents, according to Head Le Thi Nga, during the reporting period, through the inspection of legal documents for 2,948 documents, it was discovered, concluded and recommended to handle 138 documents with illegal provisions on authority and content.

This result shows that the number of documents with illegal provisions is still high, but so far only 80/138 documents have been processed, the number of documents that have not been processed is 58. Therefore, the Government is requested to clarify the reasons why 58/138 illegal documents have not been processed to date./.
