The Ministry of Home Affairs discussed and provided guidance on resolving some difficulties and problems in the management of civil servants and public employees.
Specifically, the Ministry of Home Affairs issued Official Dispatch 6392/BNV-CCVC on exchanging expertise on the difficulties and problems of the Department of Home Affairs of Tay Ninh province. This is also a common problem of many localities in managing civil servants and public employees after the arrangement of administrative units and the transition to a 2-level local government model.
Consider continuing to recruit civil servants if qualified.
One of the problems is the cases of candidates who were selected in the commune-level civil servant recruitment exam organized by the district-level People's Committee in the past, but have not yet been issued a recruitment decision due to the implementation of the temporary suspension policy according to Conclusion No. 128-KL/TW of the Politburo .
The Ministry of Home Affairs said that on June 27, 2025, the Politburo and the Secretariat issued Conclusion No. 171-KL/TW on continuing to deploy and complete the task of reorganizing the apparatus and administrative units, in which it concluded: "From July 1, 2025, provincial Party Committees, city Party Committees, and Party Committees directly under the Central Committee shall carry out personnel work according to their authority, ensuring compliance with the regulations of the Party and the State (terminating the validity of Conclusion No. 128-KL/TW dated March 7, 2025 of the Politburo on personnel work policy)".
Clause 1, Article 70 of Decree No. 170/2025/ND-CP1 stipulates: “In case the first round of recruitment has been completed before the effective date of this Decree, recruitment may continue in accordance with current law within 3 months from the effective date of this Decree; in case it is not completed within 3 months, the recruitment period shall be canceled”.
Therefore, for cases that have passed the recruitment exam for commune-level civil servants conducted by the District People's Committee (previously), but have not yet issued a recruitment decision due to the implementation of the policy of temporarily suspending recruitment according to Conclusion No. 128-KL/TW dated March 7, 2025 of the Politburo, localities need to review the standards, conditions, job positions for successful candidates and the actual number of civil servants present compared with the payroll framework of the commune-level government prescribed in Official Dispatch No. 9/CV-BCĐ.
In case of meeting all standards and conditions and still having staffing quotas and recruitment needs according to the requirements of the job position at the commune level (new), consider and decide to continue recruiting civil servants according to authority.
Flexibility in ranking for leadership and management civil servants
Regarding the ranking of senior specialists and senior specialists for civil servants assigned to leadership and management positions, the Ministry of Home Affairs said that in the case of holding leadership and management positions and titles as prescribed in Point a and Point b, Clause 2, Article 70 of Decree No. 170/2025/ND-CP but not yet assigned to the corresponding rank, the agency employing civil servants shall report to the competent agency managing civil servants for consideration and assignment of the corresponding civil servant rank (not requiring a certificate of training in state management knowledge and skills and meeting the time limit for holding the adjacent lower rank) according to regulations.
In case of meeting the appointment standards and conditions, the ranking corresponding to the position and title will be carried out simultaneously in the appointment decision.
Regarding the Commune-level Military Command and non-professional commune-level workers, the Ministry of Home Affairs is currently coordinating with the Ministry of National Defense to guide the recruitment and salary arrangement for the Commander, Deputy Commander, and Assistant of the Commune-level Military Command (new).
For now, it is recommended that localities temporarily maintain the status quo of regimes and policies for those working at the Commune-level Military Command until there are specific instructions from competent authorities.
Regarding the admission of non-professional workers to civil service positions, it is recommended to do so after the job position project has been approved by the competent authority.
