Proposal to expand the scope of public housing rentals

(Chinhphu.vn) - The Ministry of Construction is drafting a Prime Minister's Decision on expanding the subjects of renting public housing in localities subject to the arrangement of provincial-level administrative units.

The Ministry of Construction proposes to expand the subjects of renting public housing in localities subject to the arrangement of provincial-level administrative units.

The Ministry of Construction said that on June 12, 2025, the National Assembly passed Resolution No. 202/2025/QH15 on the arrangement of provincial-level administrative units, according to which after the arrangement, the whole country will have only 34 provincial-level administrative units (23 units subject to arrangement, 11 units remain the same).

On April 14, 2025, the Prime Minister issued Decision No. 758/QD-TTg promulgating the Plan to implement the arrangement of administrative units and build a model of organizing two-level local governments and Decision No. 1581/QD-TTg dated July 22, 2025 promulgating the Plan to continue perfecting the organization of the political system and preparing for Party Congresses at all levels, in which the Ministry of Construction is assigned to issue guidelines for implementing the public housing policy for cadres, civil servants and public employees who must relocate after the arrangement of administrative units.

Implementing the direction of the Prime Minister in Decision No. 758/QD-TTg dated May 13, 2025, the Ministry of Construction issued Document No. 3336/BXD-QLN, requesting localities to report on public housing needs and recommend amending and supplementing public housing policies after implementing the arrangement of administrative units. Through synthesizing the public housing needs of localities, for localities not subject to the arrangement of provincial-level administrative units, there is almost no need for public housing. For 23 provinces subject to the arrangement of administrative units, the public housing needs of cadres, civil servants and public employees are about 45,000 people (previously the need was only about 1,000 people according to Document No. 632/BXD-QLN dated March 2, 2022 of the Ministry of Construction). At the same time, localities subject to the arrangement of administrative units proposed to issue policies to expand the subjects of public housing rental to cadres, civil servants and public employees and supplement regulations on area standards and interior equipment norms for these subjects.

Therefore, it is necessary to issue a Decision to expand the subjects of renting public housing in localities subject to the arrangement of provincial-level administrative units to ensure that officials have a stable life and peace of mind at work.

In case a person owns a house but is far from the workplace, he/she is entitled to the policy on public housing.

According to the draft, the subjects renting official housing are cadres, civil servants and public employees in localities subject to the arrangement of provincial-level administrative units. The distance from the housing they own to the workplace (including: main office, branch or representative office of the agency or organization) must be from 30 km or more in the plains and from 15 km or more in the mountainous areas.

Area and interior equipment standards

According to the draft, heads of departments, deputy heads of departments of the Department and equivalent, civil servants and public employees in localities subject to the arrangement of provincial-level administrative units are arranged to rent one of two types of public housing, including:

Apartment with usable area from 45 m2 to under 60 m2 meeting the requirements specified in Point c, Clause 1, Article 3 of Decision No. 11/2024/QD-TTg dated July 24, 2024 of the Prime Minister on area standards and interior equipment norms of public housing. Specifically: Apartment with usable area from 45 m2 to 160 m2 , designed as a closed living space, with one or more different functional spaces such as: Living room, bedrooms, dining room, kitchen, toilet, balcony or loggia.

The house has a usable area from 24 m2 to under 48 m2, ensuring the requirements specified in Point d, Clause 1, Article 3 of Decision No. 11/2024/QD-TTg. Specifically: A level IV townhouse has an usable area from 24 m2 to 60 m2 , built in the style of a 1-storey house with many houses close together, each house has a closed auxiliary structure. The minimum usable area is 24 m2 /house.

The maximum budget for interior equipment for the above-mentioned official residence is 80 million VND.

According to the draft, the Ministry of Construction is responsible for guiding, inspecting and urging localities across the country to implement the regulations.

The People's Committees of provinces and centrally run cities are responsible for allocating capital from local budgets to invest in construction, renovation, repair, and purchase of interior equipment for public housing according to regulations; directing the development, management, and arrangement of leasing of public housing in the locality according to the provisions of the law on housing and in accordance with the actual conditions of the locality.
