On the afternoon of November 9, a leader of the Hanoi Citizen Reception Committee confirmed that the unit had just received a complaint from Ms. Pham Thi Hoa, former Permanent Vice Chairwoman of the People's Committee of Ha Dong District. In the complaint, Ms. Hoa complained about the process of handling the complaint and the issuance of Decision No. 5600/QD-UBND dated November 2, 2023 of the City People's Committee on the dismissal of officials.
Ms. Pham Thi Hoa spoke at a conference when she was Vice Chairwoman of the People's Committee of Ha Dong District.
Specifically, on August 3, Ms. Hoa submitted an application for early retirement. However, after submitting the application, she has not been met, discussed, or given instructions on the State's regulations and policies regarding her case by any official or organization; and has not received any comments from the competent authority regarding whether or not to approve her retirement application.
Notably, the former Vice Chairwoman of the People's Committee of Ha Dong District stated that the process of processing her application and issuing the decision to dismiss her from work did not ensure publicity, transparency, democracy, and affected her personal rights.
Regarding the reason for submitting her application for early retirement in August, Ms. Hoa said that she considered the arrangement of her rotation to the grassroots level to be inconsistent with the Party's policy on training and strengthening cadres and leaders for key units.
Meanwhile, Ms. Hoa is 54 years and 5 months old. Her working time is not enough for half of her term, so she is not enough to do well in her new task. Transferring her to the ward-level Party Committee will make it difficult to arrange personnel for the next term of the grassroots Party Committee. Therefore, Ms. Hoa said that the reason she asked to resign was because the district planned to arrange for her to do other work that she did not find suitable. From there, she wished to resign from the regime, also known as early retirement.
However, Decision No. 5600/QD-UBND dated November 2 of the Hanoi People's Committee was based on Decree No. 46 regulating termination of employment and retirement procedures for civil servants.
"This decision is essentially to let me quit my job and receive severance pay, which is not in accordance with the content of my previous request. After nearly 34 years of work, what is my 'status' after receiving Decision No. 5600/QD-UBND? Leader? Cadre? Retired? Or a citizen voluntarily paying social insurance? I request that the Hanoi People's Committee let me retire according to Decree 29 of the Government , which is more appropriate," the former Vice Chairman of the People's Committee of Ha Dong District added.
In addition, Ms. Hoa also complained about the issuance time and validity period of Decision No. 5600/QD-UBND. Because the decision was signed and issued on November 3 but took effect from November 1. Therefore, during this period, Ms. Hoa still worked, handled, directed and operated normal tasks at the agency and attended city meetings as assigned by the Chairman of the People's Committee of Ha Dong District.
When the above information was reported by the press, many people misunderstood, seriously affecting her reputation and personal honor. Therefore, Ms. Hoa requested the authorities to investigate, verify and revoke Decision No. 5600/QD-UBND to ensure her legitimate rights and interests.
It is known that before being elected as the Permanent Vice Chairman of the People's Committee of Ha Dong District in 2014, Ms. Hoa was the Head of the Department of Education and Training of Ha Dong District. According to regulations, Ms. Hoa still has more than 2 years of work left before reaching retirement age.
