Perfecting the legal corridor to promote investment, production and business in the high-tech sector

On the afternoon of September 23, in Ho Chi Minh City, the National Assembly's Committee on Science, Technology and Environment coordinated with the Ministry of Science and Technology to organize a workshop to collect comments on the draft Law on High Technology (amended).

The draft Law consists of 6 chapters and 29 articles, reducing 6 articles and having some changes in structure and form compared to the current Law. It is expected that this law will be submitted to the National Assembly for consideration and approval at the upcoming 10th Session.

The Law on High Technology, issued in 2008, is the first and only law regulating high technology in Vietnam and has been amended to a limited extent in small provisions in 2013, 2014 and 2025, but there has been no comprehensive amendment to meet practical requirements and be consistent with the rapidly and profoundly changing domestic and international legal and socio -economic context. Practice shows that the Law on High Technology has revealed many limitations and inadequacies in both content and implementation, and has not played a role in promoting the strong development of domestic high technology capacity.

Associate Professor, Dr. Vu Hai Quan, Permanent Deputy Minister of Science and Technology, emphasized that one of the important goals of amending the Law on High Technology is to remove obstacles and shortcomings from reality, create an effective legal corridor for developing domestic high technology, improve endogenous technology capacity, and move towards global technology competition.

This amendment to the Law also aims to concretize and implement the Party's major policies, especially Resolution No. 57-NQ/TW of the Politburo, thereby creating a transparent, stable and attractive legal corridor for investment, production and business activities in the high-tech sector.

Accordingly, the draft Law focuses on 6 policy groups: Perfecting the concept and criteria of high technology; redesigning the system of policies and beneficiaries of priority, incentive and investment support policies; encouraging the development of the high-tech ecosystem; supplementing new regulations on high-tech park and high-tech urban models; supplementing and perfecting state management regulations on high technology, management, inspection, supervision and efficiency assessment mechanisms; supplementing regulations on requirements for comprehensive digital transformation of high-tech activities.

At the workshop, delegates highly appreciated the draft Law's design based on the principle of cutting down procedures, simplifying administrative procedures through strengthening post-auditing, comprehensive digital transformation in high-tech management and operations. Attracting non-state investment sources for high technology through encouraging enterprises to invest, funding for research and development of high technology, strategic technology, high-tech products, and strategic technology products. Along with that, the addition of regulations on periodic or ad hoc review and assessment of the List of strategic technologies and high-tech products, strategic technology products encouraged for development, to ensure updating and quick adaptation to global technological changes. The draft Law is designed based on the principle of cutting down procedures, simplifying administrative procedures through strengthening post-auditing, comprehensive digital transformation in high-tech management and operations.

The Draft Law also completes the definition of high technology, emphasizing the breakthrough, spreading and fundamental role of modern manufacturing and service industries; completes the definition of high-tech products as not only products but also services created from high technology; amends the mechanism for determining priority technology, instead of listing 4 fixed fields, switching to open criteria on high technology and strategic technology...

Delegates also said that it is necessary to clarify the term high technology, because this is a core concept that runs throughout the law. In particular, this concept needs to be clarified that high technology must demonstrate novelty, modernity and value in a certain space and time. The draft Law also needs to explain the terms to clarify technology localization, technology decoding, technology mastery; criteria for determining high-tech enterprises, strategic technology; and the relationship between high-tech zones and high-tech cities.
