Fine of 20-30 million VND if university enrolls students with incorrect information as announced

Many regulations on administrative sanctions in the field of education have been revised and supplemented by the Ministry of Education and Training in the new draft, including contents on enrollment.

The Ministry of Education and Training has just announced the Draft Decree amending and supplementing a number of articles of Decree No. 04/2021 of the Government regulating administrative sanctions in the field of education , which has been amended and supplemented a number of articles according to Decree No. 127/2021 of the Government to solicit comments.

Abolish some phrases and terms that are no longer relevant

According to the Ministry of Education and Training, after nearly 5 years of implementing administrative sanctions according to the provisions of Decree No. 04, supplementing a number of articles according to Decree No. 127, the Ministry of Education and Training has organized many inspection teams to implement administrative sanctions in the field of education, applying many remedial measures according to regulations.

However, when imposing penalties on some acts related to educational autonomy, some inadequacies have been revealed compared to the reality of educational activities and changes in the law on education, especially university education. For example, the penalty for the act of enrolling students exceeding the quota according to the regulation on determining the quota at a level exceeding 3% is too low, not suitable for practice...

To ensure that administrative sanctions in the field of education are in accordance with the provisions of law and in accordance with current practice, the amended and supplemented decree is very necessary.

In this draft, the Ministry of Education and Training abolishes a number of phrases, points, clauses, and articles that are no longer appropriate, such as the phrase "junior college" which is no longer regulated in the Law on University Education, abolishes the content of penalties related to junior colleges, and amends, supplements, and clarifies a number of contents related to the level of violations and remedial measures.

Clarifying violations in exceeding enrollment targets

The Ministry of Education and Training said the new decree will be amended and supplemented to clarify the level of violations in the act of enrolling students with incorrect information; focusing on enrolling students beyond the quota but not exceeding the capacity and enrolling students with incorrect methods in the enrollment information.

In addition, clarify the act of enrolling students in excess of the quota according to the regulations on determining quotas of competent state management agencies in the direction of adding the absolute excess number.

Specifically, in Clause 2, which stipulates a fine of 20-30 million VND (under Article 8, Violations of regulations on enrollment organization), the Ministry added Clause c as follows: Conducting enrollment not in accordance with the enrollment method prescribed by the Minister of Education and Training or not in accordance with the announced enrollment information.

The Ministry also revised and supplemented the fine of 30-40 million VND for acts of not announcing enrollment information or announcing incomplete enrollment information according to current regulations and conducting enrollment not in accordance with announced enrollment information.

Regarding the act of recruiting in excess of quota, if the old decree only regulated the percentage, in this draft the Ministry combines the percentage with specific quantity to clarify the violations that need to be punished.

For example, a fine of 5-10 million VND will be imposed for recruiting 3% or more students and the number of students will be from 10 to 30 students; a fine of 10-30 million VND will be imposed for recruiting 3% or more students and the number of students will be from 31 to 60 students.

Fines of 30-50 million VND for recruiting 3% or more in excess and with an excess of 61 to 100 students; fines of 50-70 million VND for recruiting 3% or more in excess and with an excess of 101 students or more.
