General Secretary To Lam: Removing arising problems, ensuring the unity and synchronization of the legal system

On the morning of September 18, at the Party Central Committee Headquarters, General Secretary To Lam chaired a working session with the Standing Committee of the Government Party Committee on a number of contents of four draft laws: Land Law (amended); Planning Law; Urban and Rural Planning Law; Investment Law.

Attending the working session were comrades: Politburo member, Secretary of the Government Party Committee, Prime Minister Pham Minh Chinh; Politburo member, Secretary of the Party Central Committee, Chairman of the Central Inspection Committee Nguyen Duy Ngoc; Politburo member, Permanent Deputy Secretary of the Government Party Committee, Permanent Deputy Prime Minister Nguyen Hoa Binh ; comrades of the Party Central Committee, Government leaders, leaders of ministries, departments and central branches.

Speaking at the working session, General Secretary To Lam emphasized that the draft laws are closely related to many intertwined regulations. In the context of simultaneously amending laws, it is easy for conflicts and overlaps to arise, leading to the need to continue amending in a short period of time, so they must be carefully considered. The contents discussed are all big and difficult issues, requiring intellectual concentration and dedication, ensuring the fundamental resolution of difficulties and problems in practice and the synchronization and unity of the legal system, aiming to open the way, unleash all resources, and turn institutions and laws into competitive advantages and strong driving forces for development.

Regarding the draft Law on Land (amended), the General Secretary suggested that it is necessary to ensure requirements, fully identify difficulties and obstacles in the current land sector; ensure a comprehensive, fundamental and synchronous handling plan; the major viewpoints, orientations and important policies of the law amending and supplementing a number of articles of the Law on Land need to be placed in the overall context with related laws on tax, housing, real estate business, planning, geology and minerals... The Government Party Committee leads and directs relevant agencies to focus on urgently and seriously implementing the development of a review report, proposing solutions to remove difficulties caused by legal provisions in the land sector, serving the amendment and supplementation of the Law on Land; continue to carefully study options for harmonious handling and removing obstacles.

The General Secretary stated that the Land Law is an important law with a very large scope of impact, directly related to the rights and interests of the State, enterprises and people, so the amendment must be identified as a key and urgent task and must be invested with resources and time to implement seriously and effectively. Fully identify bottlenecks, carefully consider the fundamental and root causes of the problem so that the proposed plan must ensure to remove obstacles, unblock resources, harmonize interests, avoid hot spots, disputes and complaints that affect the general political atmosphere; at the same time, do not let hostile forces take advantage of distorting policies in amending and supplementing the Land Law.

Regarding the Investment Law project, thoroughly implement the direction in Resolution No. 68-NQ/TW dated May 4, 2025 of the Politburo on private economic development; must create a business environment that is open, transparent, stable, safe, easy to implement, low cost, meets international standards, ensures regional and global competitiveness; at the same time, remove existing "bottlenecks" and create more favorable conditions for business development. Regulations on investment and business conditions reflect the spirit of "strongly shifting from pre-inspection to post-inspection associated with strengthening inspection and supervision"; ensure that the conditional investment and business sectors and professions are set "for reasons of national defense, security, social order and safety, social ethics, and public health", and the rest are thoroughly cut in accordance with the Party and State's policies. The regulations on investment incentive sectors and occupations need to cover all policies on developing renewable energy, nuclear energy, and new energy mentioned in Resolution No. 70-NQ/TW dated August 20, 2025 of the Politburo on ensuring national energy security until 2030, with a vision to 2045.

Regarding the draft Law on Planning, the General Secretary requested an assessment of the abolition and adjustment of a number of national sectoral plans, and attention to handling conflicts between plans to ensure that investment projects do not waste too much time, and at the same time can continue to be implemented according to plans that are operating stably, not affected by the organization of two-level local governments, and avoid waste. The development of the Law on Planning must ensure the national development vision; build comprehensive, long-term infrastructure and solve infrastructure development tasks to lead the overall development; continue to decentralize, delegate power, clearly define authority in planning work, associated with simplifying processes and procedures in planning activities, ensuring synchronization of decentralization and delegation of power in the spirit of "locality decides, locality does, locality is responsible"; continue to study additional regulations to handle shortcomings in the planning system, the relationship between types of planning and assess the suitability of projects to planning.

Regarding the draft Law on Urban and Rural Planning, there are many specific contents related to the Land Law (amended) and a number of other related laws, which need to be initially reviewed for amendment and supplementation to ensure the removal of difficulties arising in practice, while ensuring consistency, synchronization and connectivity in the legal system.

The General Secretary requested the Government Party Committee to focus resolutely and direct relevant ministries and agencies to invest intellectual resources and enthusiasm, closely following the requirements to complete the draft law with quality and achieve the set goals; the Central Party Office synthesizes the report content in the submission, the opinions exchanged at the meeting to report to the Politburo for opinions on the contents under its authority.
