Adjusting the time for organizing consultative conferences and conferences to collect opinions from voters at the place of residence

On the morning of September 26, continuing the 49th Session, under the direction of Vice Chairwoman of the National Assembly Nguyen Thi Thanh, the National Assembly Standing Committee gave opinions on two draft Resolutions related to organizing meetings with voters and introducing candidates for National Assembly and People's Council deputies.

At the meeting, the National Assembly Standing Committee gave opinions on the draft Resolution of the National Assembly Standing Committee regulating the organization of voters' conferences; the introduction of candidates for People's Council deputies at the commune level in villages and residential groups; the consultation, introduction of candidates, and the list of candidates for National Assembly deputies and People's Council deputies in the supplementary election, and the draft Joint Resolution of the National Assembly Standing Committee, the Government and the Presidium of the Central Committee of the Vietnam Fatherland Front guiding the process of consultation and introduction of candidates for the 16th National Assembly and People's Council deputies at all levels for the 2026-2031 term.

The report on the drafting of a Resolution of the National Assembly Standing Committee regulating the organization of voters' conferences; the introduction of candidates for People's Council deputies at the commune level in villages and residential groups; the consultation, introduction of candidates, and the establishment of a list of candidates for National Assembly deputies and People's Council deputies in the by-election was presented by Vice Chairman of the Central Committee of the Vietnam Fatherland Front Hoang Cong Thuy.

Accordingly, the Resolution is developed to provide correct and complete guidance on the regulations on organizing voters' conferences, introducing candidates for People's Council deputies at the commune level in villages and residential groups, consulting and introducing candidates for deputies, making lists of candidates for National Assembly deputies and People's Council deputies in by-elections in the Law on Election of National Assembly Deputies and People's Council Deputies, ensuring unified and effective implementation nationwide. The draft Resolution consists of 4 chapters and 9 articles.

Regarding the form of organizing voters' conferences at the workplace (Article 1), the draft Resolution has added two forms of organizing opinion gathering, including organizing online conferences or organizing the distribution of opinion ballots, clearly defining the authority to decide on organizing the two forms according to the scope and level of influence and specifically regulating the implementation method in Clause 4, Article 1 of the draft Resolution.

In addition, the above two forms are also added for organizing conferences to collect voters' opinions at the place of residence.

Presenting the Verification Report, Chairman of the Delegation Work Committee Nguyen Thanh Hai stated that the Committee agreed with the drafting of the Resolution following a shortened order and procedure.

The Delegation Work Committee agrees with the proposal to amend the content of the regulations on the subject of chairing and convening voters' conferences in state agencies, political organizations, socio-political organizations, social organizations, public service units, and economic organizations, specifically amending the phrase "head" to "Leadership Board" to ensure democracy and objectivity in agencies, organizations, and units at the voters' conference and is also suitable in cases where the "head" is a candidate or the agency, organization, or unit has not yet completed the "head".

However, regarding the determination of the composition of the "Leadership Board" at Point g, Clause 2, Article 1 of the draft Resolution, to ensure objectivity, it is recommended that the drafting agency study and add that in the case where the head of an agency, organization or unit is a candidate, the deputy head will coordinate with the head of the agency, organization or unit to determine the composition of the Leadership Board of the agency, organization or unit.

Presenting the draft Joint Resolution of the National Assembly Standing Committee, the Government and the Presidium of the Central Committee of the Vietnam Fatherland Front guiding the process of consultation and introduction of candidates for the 16th National Assembly and People's Councils at all levels for the 2026-2031 term, Vice Chairman of the Central Committee of the Vietnam Fatherland Front Hoang Cong Thuy stated that the draft Joint Resolution amends 24/29 articles (accounting for 82.7%) of Joint Resolution No. 09. Pursuant to the provisions of Article 8 and Article 51 of the Law on Promulgation of Legal Documents in 2025, the Standing Committee drafted a Resolution to replace Joint Resolution No. 09.

The draft Resolution consists of 6 chapters and 29 articles. To ensure consistency with the regulations on the election date of March 15, 2026 and the time for organizing consultation sessions stipulated in Law No. 83/2025/QH15 amending and supplementing a number of articles of the Law on Election of National Assembly Deputies and People's Council Deputies, the draft joint Resolution amends all the time frames in the steps of the consultation process and candidate introduction.

Specifically, adjusting the time for organizing the first consultative conference to be held in the period from December 1, 2025 to December 10, 2025; adjusting the time for agencies, organizations and units to introduce candidates for National Assembly deputies and People's Council deputies to be held in the period from December 12, 2025 to January 25, 2026; adjusting the time for organizing the second consultative conference to be held in the period from February 2, 2026 to February 3, 2026; adjusting the time for organizing the third consultative conference to be held in the period from February 9, 2026 to February 20, 2026.

At the same time, adjust the time for organizing conferences to collect opinions and trust from voters at the place of residence for candidates for People's Council deputies and voters at the place of work; the time for verifying and responding to issues raised by voters regarding candidates for National Assembly deputies and People's Council deputies; the time for the second adjustment of the structure, composition and number of candidates for National Assembly deputies.

Presenting the Report on the review of this content, Chairman of the Delegation Affairs Committee Nguyen Thanh Hai said that the Committee found that the timelines in the process of consultation and nomination of candidates stipulated in the draft resolution are consistent with the timelines stipulated in Resolution No. 199/2025/QH15 of the National Assembly on shortening the term of the 15th National Assembly and People's Councils at all levels for the 2021-2026 term; Election date of the 16th National Assembly and People's Councils at all levels for the 2026-2031 term and the consultation steps stipulated in the Law on Election, which has been amended and supplemented by a number of articles in Law No. 83/2025/QH15.

Therefore, the Delegation Work Committee agrees with the timelines for conducting consultations and introducing candidates for National Assembly and People's Council deputies in the draft Resolution.

The Committee also basically agrees with the provisions on the number of candidates at the second and third consultation conferences as in the draft Resolution. However, there are opinions suggesting that it is necessary to consider regulating the number of candidates at the first consultation conference. Researching and supplementing the provisions on the number of candidates at the first consultation conference is necessary to create a proactive basis, ensure balance in structure, gender, composition, ethnicity, young people, limit risks in the next consultation steps and contribute to improving feasibility, transparency and quality.

The correction must be clear enough to be done immediately.

Commenting at the meeting, Vice Chairman of the National Assembly Nguyen Khac Dinh stated that these are two very important documents to prepare for the upcoming election. Speaking at the recent 1st National Assembly Party Congress, General Secretary To Lam emphasized that one of the most important tasks of the National Assembly Party Committee is to coordinate with relevant agencies to lead and direct the organization of the election of National Assembly and People's Council deputies. "That shows that this election has very high political and legal requirements in the atmosphere of innovation in thinking, innovation in leadership organization, management, and coordination. Therefore, amending the two Resolutions is very necessary."

Emphasizing this, the Vice Chairman of the National Assembly also welcomed the Standing Committee of the Central Committee of the Vietnam Fatherland Front for coordinating with agencies to submit two draft Resolutions to the Standing Committee of the National Assembly; highly appreciated the Delegation Work Committee for organizing the examination and giving very specific opinions. At the same time, he noted that the amended contents in the two Resolutions must be clear enough to be implemented immediately, any issues that need detailed regulations must be included in the draft Resolution.

Regarding the organization of conferences to collect voters' opinions at the workplace, the Vice Chairman of the National Assembly suggested that the current regulations for the National Assembly and its agencies should be maintained, with the National Assembly bloc only organizing a joint conference to ensure speed. If there is any amendment, it should be adjusted in the direction that the Head of the National Assembly Office coordinates with the Chairman of the Nationalities Council and the Chairmen of the Committees to convene the conference.

Regarding the draft Joint Resolution, the Vice Chairman of the National Assembly agreed with the regulations on the number of candidates at the three consultation conferences. Regarding the composition of the expanded Executive Board Conference, it is necessary to specify who the expanded Executive Board consists of and how many members are to ensure ease of deployment and implementation.

Appreciating the process, efforts and attempts to prepare the dossiers of the 2 draft Resolutions of the Central Committee of the Vietnam Fatherland Front and basically agreeing with the Verification Reports of the Delegation Work Committee, Permanent Deputy Head of the People's Aspirations and Supervision Committee Le Thi Nga expressed her agreement with the viewpoint of Vice Chairman of the National Assembly Nguyen Khac Dinh regarding the organization of a conference to collect voters' opinions at the workplace. As usual in previous terms, the National Assembly Office organized a general conference without assigning to the Ethnic Council and the National Assembly Committees.

Therefore, the Standing Deputy Chairman of the People's Aspirations and Supervision Committee proposed that it should be organized as before; assigning the National Assembly Standing Committee to organize a joint conference for all delegates of the National Assembly bloc running for National Assembly deputies.

In her concluding remarks, Vice Chairwoman of the National Assembly Nguyen Thi Thanh stated that the National Assembly Standing Committee basically agreed with many contents of the two draft Resolutions and the contents of examination, explanation and acceptance.

The National Assembly Standing Committee proposed to carefully review and compare with current regulations on streamlining the organization of the political system to adjust in the direction of unified regulations, design provisions according to groups of agencies from the central to local levels, ensuring that no subjects are left out or lacking in the collection of voters' opinions at their workplaces.

At the same time, update to ensure compliance with regulations on decentralization of cadre management; review to synchronize, unify, understand and clarify the meaning of new words and terms used in the draft Resolution. Organizing online voters' conferences at the place of residence must ensure publicity, information security and suitability with actual conditions.

Regarding the draft Joint Resolution, the Vice Chairman of the National Assembly noted that it is necessary to clearly stipulate the required balance ratio of candidates at the consultation conferences; clearly define the authority to consider special cases where candidates do not gain the confidence of more than 50% of the total number of voters at their place of residence.

The Vice Chairman of the National Assembly assigned the drafting agency and the agency in charge of reviewing to fully absorb the opinions of the National Assembly Standing Committee and coordinate to urgently complete the two draft Resolutions.

Next, 100% of the members of the National Assembly Standing Committee present voted in principle to approve the Resolution of the National Assembly Standing Committee regulating the organization of voters' conferences; the introduction of candidates for People's Council deputies at the commune level in villages and residential groups; the consultation, introduction of candidates, making a list of candidates for National Assembly deputies, candidates for People's Council deputies in the supplementary election and the draft joint Resolution of the National Assembly Standing Committee, the Government and the Presidium of the Central Committee of the Vietnam Fatherland Front guiding the process of consultation and introduction of candidates for National Assembly deputies of the 16th term, People's Council deputies at all levels for the 2026 - 2031 term.
