The issue of continuing education continues to be a concern for parents on forums, many people wonder if teachers are allowed to open a center for continuing education?
According to Clause 1, Article 80 of Decree 01/2021, the law does not prohibit teachers from establishing business households. However, Clause 3, Article 4 of Circular 29/2024 stipulates that teachers at public schools are not allowed to participate in the management and operation of extra-curricular teaching.

Pursuant to Article 81 of Decree 01/2021, business owners have the following obligations:
- Perform tax obligations, financial obligations and business activities of business households according to the provisions of law.
- The business household owner represents the business household as the person requesting the settlement of civil matters, the plaintiff, the defendant, the person with related rights and obligations before the Arbitration, the Court and other rights and obligations as prescribed by law.
- Business owners can hire other people to manage and operate the business activities of the business household.
- Responsible for the business activities of the business household.
- Other rights and obligations as prescribed by law.
Based on the above regulations, if a business household is established to organize extra classes, the business household owner will have to manage, operate and be responsible for the obligations arising from the extra classes outside of school.
Thus, teachers at private schools can register their own business to organize extra classes. Teachers at public institutions are not allowed to organize, operate, or manage extra classes, but can only participate in extra classes outside of school under contract.
Regulations on extracurricular teaching
Article 6 of Circular 29/2024 stipulates that organizations or individuals that organize extra teaching and learning activities outside of school that collect fees from students, in addition to registering their business according to the provisions of law, must also publicly disclose information about the subjects they organize extra teaching.
Along with that, organizations or individuals teaching extra classes are required to publicly disclose the number of extra classes for each subject according to each grade level; location, form, and time of organizing extra classes; list of extra teachers and tuition fees before enrolling students for extra classes.
Extracurricular tutors need to ensure they have good moral qualities and professional competence appropriate to the subjects they teach.
At the same time, teachers who are teaching at schools and participate in extracurricular teaching must report to the Principal, Director or head of the school about the subjects, location, form and time of extracurricular teaching.
