Towards the 1st National Assembly Party Congress, term 2025-2030: Perfecting institutions and laws, strengthening national defense, security, and foreign affairs, meeting the requirements of the task of protecting the Fatherland in the new situation

The 1st National Assembly Party Congress, term 2025-2030, takes place in the context that the entire Party, people and army are resolutely implementing the tasks of the 13th National Congress, towards the 14th National Party Congress, with many intertwined opportunities, advantages and challenges.

In the world, the international political and security situation continues to evolve rapidly, complexly, and unpredictably; strategic competition between major countries increases; local conflicts, sovereignty disputes, non-traditional security, climate change, global epidemics, etc. pose enormous challenges to all countries.

Domestically, after nearly 40 years of Renovation, Vietnam's position, strength, national comprehensive power, and international prestige have never been as high as they are today. However, the cause of defending the Socialist Republic of Vietnam still faces increasingly high demands: Maintaining a peaceful and stable environment for development, while firmly protecting independence, sovereignty, territorial integrity, protecting the Party, State, people, and socialist regime.

The work of building and perfecting laws has many innovations and creations.

To meet the above requirements, the legal system in general and in the fields of national defense, security and foreign affairs in particular must be built and perfected at a higher level, overcoming obstacles and shortcomings, ensuring predictability and stronger adaptability.

Therefore, building and perfecting institutions and laws to strengthen national defense, security, and foreign affairs, meeting the requirements of protecting the Fatherland in the new situation is one of the urgent requirements being posed.

During the term of the 15th National Assembly, the Committee for National Defense, Security and Foreign Affairs always closely followed the Party's policies, guidelines and viewpoints on national defense, security and foreign affairs; the direction of the Party Committee of the National Assembly, the Standing Committee of the National Assembly, the Party Committee of the Committee for National Defense, Security and Foreign Affairs; closely coordinated with relevant agencies, presided over the examination and submitted to the National Assembly for approval 21 draft laws, 1 resolution of the National Assembly, 1 resolution of the Standing Committee of the National Assembly and 3 international treaties; coordinated the examination of 148 draft laws, ordinances and 70 draft resolutions.

The Committee has proposed and signed 19 cooperation agreements with parliaments of other countries, including establishing an inter-parliamentary cooperation committee mechanism with China and Cuba. Draft laws, ordinances and resolutions chaired by the Committee on National Defense, Security and Foreign Affairs were approved by the National Assembly with an approval rate of over 85%, many laws reaching 100%.

Notable ones include: Law on National Defense Industry, Security and Industrial Mobilization; Law on People's Air Defense; Law on Data; Law on Personal Data Protection; Resolution of the National Assembly on pilot auction of automobile license plates; Resolution of the National Assembly Standing Committee on supervision of traffic order and safety... Draft laws related to national defense, security and foreign affairs have created a solid legal basis in carrying out the task of building and protecting the Fatherland.

In recent years, along with perfecting the law on national defense, security and foreign affairs, the Committee for National Defense, Security and Foreign Affairs has also actively participated in building and perfecting the legal system in general, especially in the field of science, technology and innovation, contributing to removing bottlenecks and barriers, creating mechanisms to release resources for development. Relevant laws and policies are increasingly synchronous and tight, ensuring feasibility and timeliness, creating important premises for development.

The highlight is that the work of building and perfecting policies and laws has many innovations and creations, basically meeting the increasingly high requirements in national development in the new period.

The focus is on continuing to streamline, improve the effectiveness and efficiency of the political system apparatus, associated with promoting the application of digital technology; forming mechanisms and policies to promote the development of science and technology, creative startups, artificial intelligence (AI), big data and national digital transformation; strengthening deep international integration, expanding cooperation in research, technology transfer, digital economic development, ensuring cybersecurity; encouraging the development of the private economic sector, becoming an important driving force of the socialist-oriented market economy.

In addition to the results achieved, in the work of examining and participating in examining the drafting of legal documents, the Committee for National Defense, Security and Foreign Affairs found that although the coordination work of establishing and examining the law and ordinance drafting program has been improved, its content is still limited; the projects included in the program are mainly to handle immediate problems, and there is no scientific and reasonable legislative strategy on national defense, security and foreign affairs.

Coordination in the process of reviewing, adjusting, supplementing programs and preparing draft laws and resolutions is not yet smooth; some contents are not close to reality. Research and participation in commenting on draft laws and ordinances by some members of the Committee is still limited; the time spent reviewing each project is not satisfactory, affecting the quality of the review report. Digital data on the promulgation of legal documents has not been fully developed; the level and skills in applying digital technology and AI of a number of National Assembly deputies and experts of specialized departments are still limited.

The main reason is that the defense, security and foreign affairs sectors have a wide scope, are specific, have many sensitive contents, require confidentiality, and affect exchange and discussion activities. At the beginning of the 15th term, the impact of the Covid-19 pandemic greatly affected the implementation of programs and plans. Some draft laws and resolutions have not been submitted on time; many documents were sent late, close to the opening day of the session, causing difficulties for research and examination. Although the staff and civil servants have been strengthened, their capacity and experience are not equal; the regime and policies are still inadequate...

Fully concretize the Party's viewpoints and guidelines on protecting the Fatherland in the new situation

Promoting the achieved results, overcoming limitations, to carry out the task of "building and perfecting institutions and laws to strengthen national defense, security, and foreign affairs, meeting the requirements of the task of protecting the Fatherland in the new situation", the Party Committee of the National Defense, Security and Foreign Affairs Committee proposed a number of solutions:

Firstly , thoroughly grasp and fully concretize the Party's viewpoints and guidelines on protecting the Fatherland in the new situation, especially strategic resolutions on national defense, security and foreign affairs. Do a good job of strategic advisory work on policies and laws in the fields of national defense, security and foreign affairs to contribute to protecting the Fatherland early and from afar; develop the economy and society in the new era; do a good job of supervision to promptly detect bottlenecks, negativity and corruption.

Second , perfecting the legal system on national defense, security, and foreign affairs, ensuring consistency, feasibility, and conformity with international standards while maintaining the principles of independence, sovereignty, and territorial integrity.

Third , prioritize the development and amendment of laws related to the building of a revolutionary, disciplined, elite, and modern People's Army and People's Public Security; streamlining the apparatus; related to cybersecurity, personal data protection, non-traditional crime prevention, digital sovereignty protection, economic security, and energy security.

Fourth , strengthen coordination between the National Assembly, the Government, ministries, branches and localities in law making and enforcement; promptly resolve difficulties and overcome bottlenecks in the making, examination, reception and revision of draft laws, ordinances and resolutions.

Fifth , improve the capacity of the team of full-time National Assembly deputies, officials and experts of the Committee to be proficient in professional skills, law, technology, and basically work well in the digital and international environment; focus on in-depth training in analytical skills, international negotiation; and skills in applying digital transformation and AI.

Sixth , promote international cooperation, take advantage of experience and resources from strategic and comprehensive partners to build laws in accordance with international practices and Vietnam's conditions.

Focus on building a legal system on science and technology, innovation and national digital transformation

In the coming term, in addition to perfecting the law on national defense, security, and foreign affairs, it is necessary to focus on building a legal system on science and technology, innovation, and national digital transformation to meet the requirements in the era of national growth.

Specifically, first of all , it is necessary to perfect institutions and laws on science, technology and innovation associated with sustainable development strategies, enhance national competitiveness; encourage private enterprises and high-tech enterprises to participate in research, development and application of new technologies associated with national defense and security. Issue laws and resolutions on AI, big data, cybersecurity, digital economy, ensuring consistency with international law, suitable to Vietnam's conditions.

Second , promote digital transformation in legislative activities, supervision, and policy decisions; apply AI and open data in law-making and serving the people.

Third , strengthen training and fostering of high-quality digital human resources, improve digital technology skills, data analysis, scientific research... Promote international cooperation in science and technology, take advantage of resources, knowledge, advanced technology, while protecting digital sovereignty and national security in cyberspace.

Building and perfecting institutions and laws on national defense, security and foreign affairs is both an urgent and long-term task, requiring unified leadership of the Party, synchronous participation of the entire political system and consensus of the entire people.

With the results achieved and the proposed solutions, we believe that the legal system in general and the law on national defense, security and foreign affairs in particular will be increasingly improved, becoming an important legal basis to consolidate the nation's overall strength, maintain independence, sovereignty, territorial integrity, and firmly protect the Socialist Republic of Vietnam in all situations.
