According to the lawsuit filed in Clark County 8th Judicial District Court, the plaintiff, Jane Doe, said she was "violently and abruptly thrown the microphone" by Cardi B at Drai's Beachclub in Las Vegas on July 29, 2023.

In the hot weather, Cardi B is said to have repeatedly invited the audience to splash water on her to cool off. A clip that went viral at the time also recorded Cardi saying: “Splash water on me. It feels great.” The lawsuit claims that the rapper repeatedly signaled and encouraged the audience to splash water, even pouring water on herself and slapping her butt in response to the splash.
Doe, like many other audience members, threw water from her glass towards the stage. However, Cardi B's reaction was to throw the microphone straight into the audience, hitting Doe and causing physical injury and mental shock.

"I was immediately frightened because it was obvious I could be injured. And I was actually hit by the microphone. It was a violent, traumatic act, and there was absolutely no warning," Jane Doe described in the lawsuit.
She claimed that rapper Cardi B's actions were inappropriate, retaliatory, and unjustified. Notably, the lawsuit also revealed that this was not the first time Cardi B had thrown a microphone; the night before, she had also thrown a microphone at a DJ for cutting her song short, an incident captured in a TikTok clip.
Jane Doe's attorney argued: “Drai's Management Group knew or should have known that Cardi B was at risk of violent behavior, yet allowed her to perform without taking precautions.”
The woman is seeking compensation for the damages she has suffered over the past two years. These include: physical pain, psychological trauma, embarrassment, damage to her reputation, and harassment from the media and online community.
Thrown microphone sold for $99,000
The microphone Cardi B threw after the incident was auctioned on eBay by audio company The Wave and owner Scott Fisher, raising nearly $99,000, with the proceeds donated to charities.
Jane Doe claims that this auctioning action made her feel further insulted and deeply hurt that her pain was being made into entertainment or media.

Shortly after the incident in 2023, the Las Vegas Metropolitan Police Department opened a criminal investigation into the alleged assault but closed the case due to “lack of evidence” and did not file criminal charges against Cardi B.
Cardi B's lawyer, Drew Findling, recently spoke out about the new lawsuit: "This lawsuit is a clear and sad ploy to collect money. The case was concluded by the police and the prosecution long ago without sufficient evidence. But some law firms still want to exploit the fame for profit."
Controversy over artist responsibility
The lawsuit continues to reignite debate about how artists interact with audiences on stage.
Recently, many singers such as Harry Styles, Bebe Rexha, Ava Max, Pink... have become victims of objects thrown from the audience. However, Cardi B's incident is one of the few cases where an artist reacted violently and caused injuries to the audience, which has deeply divided public opinion.
In a public statement to People magazine, Jane Doe asserted: “What many saw as a joke became a traumatic experience that severely affected my quality of life. I want justice, because no celebrity is above the law.”
The civil lawsuit is currently pending. If found guilty, Cardi B could face both financial and emotional damages, as well as serious damage to her public image.
