On the morning of September 29, continuing the 49th session, under the direction of Vice Chairman of the National Assembly Nguyen Khac Dinh, the National Assembly Standing Committee gave opinions on the draft Law on Civil Servants (amended).

Creating connectivity in human resource use between the public and private sectors

The draft Law on Public Employees (amended) presented by Deputy Minister of Home Affairs Truong Hai Long said that the development of the Law project aims to thoroughly grasp and fully institutionalize the Resolutions, regulations and conclusions of the Party Central Committee, the Politburo and the Secretariat on building the contingent of public employees in public service units. Inheriting relevant regulations; amending inappropriate regulations; adding new mechanisms to improve the recruitment, use and management of public employees according to job positions associated with restructuring and improving the quality of the team. The draft amended Law consists of 6 Chapters and 43 Articles (19 Articles less than the current Law) with basic contents such as innovating the recruitment of civil servants in the direction of clearly stipulating that recruitment is carried out in 2 forms: examination and selection; supplementing regulations on accepting people with working experience in both the public and private sectors to work as civil servants. Determining job positions at public service units includes 3 groups: management job positions; professional and technical job positions; support job positions...

Building a team of professional staff, implementing flexible recruitment policies

The report on the review of the draft Law presented by Deputy Chairman of the Committee on Law and Justice Nguyen Truong Giang stated that the Committee agreed to comprehensively amend the Law on Civil Servants.

However, currently, some laws have specific provisions on civil servants. Therefore, to facilitate the process of law application, it is recommended to study and supplement the provisions on law application to clarify the relationship between the provisions of this Law and other relevant laws in regulating the civil servant team.

Regarding the innovation in recruitment, use and management of civil servants according to job positions (Article 3), the Committee basically agrees with the conversion of the method of managing civil servants according to job positions as prescribed in the draft Law to suit the current trend of public sector reform. Thereby, meeting the requirement of "strongly innovating methods of recruitment, assessment, planning, training, fostering, arrangement and use of cadres, civil servants and public employees in the political system" in Conclusion No. 121-KL/TW dated January 24, 2025 of the 13th Party Central Committee. Thereby, contributing to creating a legal basis for implementing salary payment according to job positions in the spirit of Resolution No. 27-NQ/TW dated May 21, 2018; ensuring consistency and unity with the method of managing cadres and civil servants prescribed in the Law on Cadres and Civil Servants.

National Assembly Chairman Tran Thanh Man stated that the draft Law marks an important step forward in modernizing the management of public human resources in Vietnam, inheriting the spirit of the 2010 Law, amended and supplemented in 2019, towards a model with civil servants as the center. The National Assembly Chairman stated that in the context of national digital transformation and international integration, the draft Law not only overcomes old shortcomings but also opens up a creative space for public service units.

The National Assembly Chairman noted that the draft Law needs to ensure increased transparency and prevent abuse in recruitment; emphasizing that determining cadres is the root of the work, selecting cadres who have enough virtue, talent, heart, capacity, strength and enthusiasm for the job, it is necessary to build a civil servant evaluation system. Along with expanding civil servants, it is necessary to balance responsibility, protect rights and common interests.

Therefore, building a team of civil servants must be professional, creating a flexible mechanism in recruitment and ensuring the legitimate rights of civil servants. At the same time, promoting digital transformation in civil servant management, building a fair, transparent and modern administration.

The National Assembly Chairman also noted that the management of civil servants by job position, innovation in civil servant recruitment methods, classification of public service units, and increased application of information technology... need clear regulations.

The National Assembly Chairman suggested that the draft Law needs to ensure consistency and synchronization with related laws that have been amended and promulgated, such as the Law on Cadres and Civil Servants; the Labor Code, the Law on Social Insurance, the Law on Public Investment, the Law on Bidding, the Land Law, the Law on Planning, etc., to avoid overlap and contradiction during implementation.

Concluding the meeting, Vice Chairman of the National Assembly Nguyen Khac Dinh stated that the National Assembly Standing Committee highly appreciated the Government, the drafting agency, and the reviewing agency for their close coordination and preparation of complete and quality draft documents.
The draft law has many innovations, contributing to the institutionalization of the Party's new guidelines and policies, meeting the country's development requirements in the coming period in the direction of building a team of professional civil servants, implementing a flexible recruitment regime, while expanding the rights of civil servants, heads of public service units, and civil servant management. At the same time, it promotes the responsibility of leaders and civil servants in activities related to the application of information technology and digital transformation.

The Vice Chairman of the National Assembly suggested that the Government complete the full draft Law dossier and send it to National Assembly deputies and the Committee on Law and Justice to complete a full review report before submitting it to the National Assembly at the upcoming 10th Session.
