On the morning of September 29, at the 4th session (special session), the People's Council of Ho Chi Minh City approved the list of land plots planned to implement pilot projects in Ho Chi Minh City in 2025 (phase 1) according to Resolution No. 171 of 2024 of the National Assembly .
54 pilot land areas with an area of over 6 million square meters
Ho Chi Minh City People's Council approved the list of 54/74 pilot land plots to implement commercial housing projects through agreements on receiving land use rights or having land use rights (including agricultural land).
This Resolution allows for the pilot implementation of commercial housing projects through agreements on receiving land use rights or having land use rights.
Instead of having to own or receive the transfer of 100% of residential land as per current law, the National Assembly's resolution allows real estate business organizations implementing pilot projects to receive the transfer of land use rights and change the land use purpose for one, some or the following types of land to implement the pilot project (agricultural land; non-agricultural land other than residential land; residential land and other land) if the land is in accordance with the planning, program and housing development plan of the locality.
The resolution identifies 54 land plots with an area of more than 6 million square meters, of which the rice-growing land area expected to change its purpose is nearly 213,000 square meters .
Regarding the list of 20/74 land plots planned to implement the pilot project that do not ensure legality, the Ho Chi Minh City People's Committee directed to review, consider, supplement and complete the submitted contents to ensure compliance with the provisions of law.
In case of ensuring full legal supplementation according to regulations, the City People's Committee shall report specifically on each project, make a list and submit it to the City People's Council no later than the end of October 2025.
Public announcement of pilot project list in 3 days
Director of the Department of Agriculture and Environment of Ho Chi Minh City Nguyen Toan Thang further explained the content of the proposed pilot land areas.
The Ho Chi Minh City People's Council assigned the Ho Chi Minh City People's Committee to continue reviewing and only organize the implementation of the project when ensuring full compliance with the conditions prescribed by law on planning, land, investment, housing, real estate business and other relevant legal provisions.
At the same time, implementing projects must ensure publicity, transparency, efficiency, feasibility, synchronization and progress, especially in wards and communes with many registered pilot projects and real estate business organizations that have registered to implement many pilot projects; promptly resolve difficulties and problems, and handle violations (if any) according to regulations, not allowing complicated complaints that cause social disorder, not allowing policy exploitation, loss and waste.
Announce and publicly post the list of land plots planned for pilot project implementation on the City's electronic information portal and direct the Department of Agriculture and Environment to publicly post on the Department of Agriculture and Environment's electronic information page.
The announcement shall be made within 3 working days from the date of approval by the City People's Council.
Ho Chi Minh City People's Committee proposed to pilot 74 land plots, about 1,100 hectares
The previous report of the Ho Chi Minh City People's Committee determined that through review, there are 74 land plots (nearly 1,100 hectares) expected to implement pilot projects in Ho Chi Minh City in 2025 (phase 1) according to Resolution No. 171 of 2024 of the National Assembly.
Of which, the residential land area is about 531.94 hectares (including existing residential land and land expected to be converted to residential land) not exceeding 30% of the additional residential land area in the planning period (compared to the current status of residential land use), according to the approved land allocation and zoning plan in the provincial planning for the period 2021 - 2030; the rice-growing land expected to be converted is 47.5 hectares.
Which includes:
- The old Ho Chi Minh City area has 15 land plots with a total area of about 69.7 hectares, of which the residential land area is about 36 hectares (including existing residential land and land expected to be converted to residential land) not exceeding 30% of the additional residential land area in the planning period (3,297 hectares); the rice-growing land area expected to be converted is 40 hectares.
- Ba Ria - Vung Tau area (old) has 59 land plots with a total area of about 1,000 hectares, of which the residential land area is about 495.8 hectares (including existing residential land and land expected to be converted to residential land) not exceeding 30% of the additional residential land area in the planning period (634.50 hectares); the rice-growing land area expected to be converted is 7.1 hectares.
