Prime Minister approves cutting administrative procedures in the field of education and training

Deputy Prime Minister Nguyen Hoa Binh signed Decision No. 1832/QD-TTg dated August 26, 2025 approving the plan to reduce and simplify administrative procedures related to production and business activities under the management of the Ministry of Education and Training in 2025.

Specifically, the Prime Minister approved the reduction and simplification of administrative procedures related to production and business activities in 10 areas: activities of preschool education institutions; activities of general education institutions; activities of continuing education institutions; activities of specialized schools; activities of foreign-invested educational institutions, representative offices of foreign education institutions in Vietnam, branches of foreign-invested educational institutions; joint training activities with foreign countries; business of study abroad consulting services; education quality assessment; vocational education; vocational education quality assessment.

At the same time, cut and simplify 5 internal administrative procedures on: recognizing provinces that have met the standards of universal education level 3 and illiteracy eradication level 2; recognizing districts that have met the standards of universal education and illiteracy eradication; recognizing communes that have met the standards of universal education and illiteracy eradication; terminating the operation of branches of public secondary schools; and establishing branches of public secondary schools.

Simplify the operations of preschool and general education facilities

The plan has simplified administrative procedures for establishing or permitting the establishment of kindergartens; primary schools; secondary schools, multi-level schools with the highest level being secondary schools; high schools, multi-level schools with the highest level being high schools. Specifically as follows:

Firstly, the time for administrative procedures to be processed for the establishment of kindergartens will be reduced from 15 days and 10 working days to 14 working days; for primary schools from 15 days and 10 working days to 15 working days. For secondary schools and high schools, the total time for administrative procedures will be reduced from 20 days and 10 working days to 17 working days.

Second, combine the two conditions on the Project to establish or permit the establishment of kindergartens, primary schools, and secondary schools into one general condition: "Having a project to establish or permit the establishment of a kindergarten/primary school/secondary school/high school in accordance with the planning of the province and related planning of the locality where the school is located, established according to Form No. 02 Appendix II attached to Decree No. 142/2025/ND-CP dated June 12, 2025 of the Government regulating the division of authority of two-level local authorities in the field of state management of the Ministry of Education and Training".

The plan also simplifies and reduces procedures to allow schools at all levels to operate educational activities by shortening the total time for handling administrative procedures from 15 days and 10 working days to 14 working days for kindergartens; from 20 days and 10 working days to 17 working days for primary, secondary and high schools.

Combine land conditions with floor area. Specifically, in the inner city areas of special urban areas, the construction floor area is calculated equivalent to the land area, but not lower than the minimum average area per student. At the same time, abolish the condition: "Having regulations on organization and operation of the school".

Regarding administrative procedures to allow educational activities to resume for all levels of schools, the Plan has added the form of submitting documents online via the National Public Service Portal. The total time to process administrative procedures for primary schools has been reduced from 7 working days to 4 working days; for kindergartens, junior high schools, and high schools from 7 working days to 5 working days.

Regarding school mergers and separations, the Plan has reduced the time to handle administrative procedures for preschool level from 10 days and 15 working days to 14 working days; primary level from 15 days and 10 working days to 15 working days; secondary and high school level from 20 days and 10 working days to 17 working days.

At the same time, three conditions were abolished: "Meeting the needs of socio-economic development"; "Ensuring the rights and interests of teachers and learners"; "Contributing to improving the quality and effectiveness of education and including explanatory content in the project of merging, dividing and separating schools" for all levels of education.

Reduce the work/activities related to copying/notarizing documents. The plan also reduces the total time to resolve school dissolution at the preschool level from 10 days to 5 working days; for 3 levels from primary to high school, from 20 days to 10 working days.

Simplifying the operations of foreign-invested educational institutions

Regarding the operation of foreign-invested educational institutions, the Plan to reduce and simplify regulations on the establishment of foreign-invested preschool and general education institutions in Vietnam. Specifically:

Firstly, change the condition: "By the time of appraisal for permission to operate education, the investment value must be over 50% of the total investment capital and the investor must commit to investing enough capital within 5 years from the date of the decision to allow operation" to the condition for allowing operation.

Second, simplify the 12 conditions into 2 general conditions on facilities for preschools and general education facilities and refer to the standards on school and classroom facilities of the Ministry of Education and Training; integrate 6 regulations on conditions on teaching staff for general education facilities into 2 conditions corresponding to each preschool and general education level and refer to the regulations of the Ministry.

Third, reduce the time for processing the verification of the validity of the dossier and sending the dossier for comments from relevant agencies and units from 5 working days to 3 working days (at Point a, Clause 2, Article 42 of Decree No. 86/2018/ND-CP); reduce to 7 working days (previously 10 days) for asking for comments from the dossier receiving agency, the agency or unit being consulted (Point c, Clause 2, Article 42 of Decree No. 86/2018/ND-CP), reduce the time from 30 working days to 20 working days for preparing dossiers, preparing dossier appraisal reports, and submitting to competent authorities (Point d, Clause 2, Article 42 of Decree No. 86/2018/ND-CP).

Regarding the regulations allowing the establishment of preschool education institutions and general education institutions with foreign investment in Vietnam at the request of foreign diplomatic missions and intergovernmental international organizations, the Plan removes the regulations on the dossier components regarding the written approval of the establishment of educational institutions in the locality and the approval in principle of land lease by the People's Committee of the province where the educational institution is expected to be established or the agreement in principle on land lease or available facilities.

At the same time, simplify 12 conditions into 2 general conditions on facilities for preschools and general education facilities and refer to the standards of school and classroom facilities of the Ministry of Education and Training; integrate 6 regulations on teaching staff conditions for general education facilities into 2 conditions corresponding to each preschool and general education level and refer to the regulations of the Ministry. The plan to reduce the processing time from 30 working days to 20 working days.
