Decision to grant amnesty and early release to prisoners sentenced to fixed-term imprisonment or life imprisonment on the occasion of the 80th anniversary of Vietnam's National Day (September 2, 2025). The time served in prison for consideration of amnesty is calculated up to August 31, 2025.
The subjects and conditions of amnesty have many new and expanded points.
The subjects of amnesty include people serving a fixed-term prison sentence, people sentenced to life imprisonment that has been reduced to a fixed-term prison sentence, and people whose prison sentence is temporarily suspended.
At the press conference, Senior Lieutenant General Le Van Tuyen - Deputy Minister of Public Security - said that this amnesty has many new points compared to the April 30 occasion, such as the subjects and conditions for amnesty being more expanded.
"Amnesty shows the special clemency of the Party and State, decided by the President in special events of the country. This year in particular, there are many important events. Therefore, the subjects and conditions of amnesty on September 2 have new points, more expanded than the recent April 30 occasion," said Senior Lieutenant General Tuyen.
Also according to Mr. Tuyen, the previous Decision 266 had four types of crimes, four groups of crimes under the provisions of Clause 8, Clause 14, 15, 16 of Article 4 of the previous Decision 266 which were not eligible for amnesty but this time they were amnesty.
For example, if a criminal intentionally causes injury to one person multiple times, or once to many people, or intentionally causes injury two or more times..., resists a person on official duty two or more times, robs property multiple times... then this time is eligible for consideration for amnesty.
The second group is those who have committed two or more intentional crimes, including cases of combined punishment or are serving a combined punishment due to being sentenced to imprisonment two or more times for the same crime, and have not been granted amnesty before, but this time will be considered for amnesty....
In addition, people with a criminal record who were sentenced to prison for an intentional crime or who were previously sentenced to prison, including those whose criminal records have been cleared or who were sent to a compulsory education facility, including a previous education facility, and were sentenced to prison for one of the following crimes: drug-related crimes, intentional injury, robbery, snatching, disturbing public order, loan sharking, etc., are also proposed for amnesty on this occasion, while not on April 30.
"Another new point about the conditions proposed for amnesty this time is the emulation classification. Currently, the emulation classification has been expanded more than before.
In addition, the Amnesty Advisory Council has also provided more specific guidance on conditions for amnesty that do not negatively affect security and order. From there, units and prisons will have more specific criteria and identification for consideration," Deputy Minister Tuyen informed.

Some conditions proposed for amnesty
Deputy Head of the Office of the President Pham Thanh Ha said the conditions for amnesty are to have made a lot of progress, have a good sense of reform, and be classified as having served the prison sentence fairly or well according to the provisions of the law on the execution of criminal sentences.
Has served at least one-third of the prison sentence in the case of a fixed-term prison sentence. If the prison sentence has been previously reduced, the reduced term shall not be counted towards the time served in prison.
Having served at least 14 years of a life sentence that has been reduced to a fixed-term prison sentence. If, after being reduced to a fixed-term prison sentence, the prison term is further reduced, the subsequent reduced term shall not be counted towards the time served in prison.
Completed additional penalty of fine and paid court fees.
Completed the obligation to return property, compensate for damages, and other civil obligations for people sentenced to prison for corruption crimes.
Having completed or partially performed the obligation to return property, compensate for damages, or other civil obligations, but due to falling into particularly difficult economic circumstances, in cases where there are no conditions to continue performing the remaining part according to the provisions of the law on civil judgment enforcement for persons sentenced to imprisonment for crimes other than corruption crimes...
When pardoned, it does not adversely affect security and order.
A person whose prison sentence is temporarily suspended and is proposed for amnesty must meet all conditions such as having made a lot of progress, having a good sense of reform, and having enough periods of being classified as good or excellent in serving the prison sentence according to the provisions of law...
