Delegating the right to recruit, mobilize and rotate teachers to the Department of Education and Training

TPO - Faced with the difficult reality of the lack of expertise and experience in the education management team at the commune and ward levels, the Ministry of Education and Training has just proposed that localities establish a commune-level education advisory council, which can mobilize retired teachers to participate in consulting and providing professional support, while at the same time giving full authority to recruit and mobilize teachers to the department level.

According to the Ministry of Education and Training , in the face of the current difficulties and problems of localities in the field of education management when implementing two-level local government such as: the management team at the Department of Culture and Society lacks expertise and experience leading to confusion and difficulties, the Ministry of Education and Training requests the Provincial People's Committee to consider and implement one or several solutions to resolve them.

Mobilizing retired officials to participate in consulting

The Ministry of Education and Training requested the provincial People's Committee to reasonably allocate the number and quality of civil servants at the provincial and communal levels, while directing the communal People's Committee to review the communal civil servants currently working at the Department of Culture and Social Affairs to ensure the right people are assigned.

Specifically, mobilize civil servants who have previously worked at the Department of Education and Training or receive and second educational management staff and teachers at all levels with appropriate expertise and experience to arrange them into positions in charge of education and training at the commune level if they meet the prescribed conditions.

As the 2025-2026 school year approaches, the education and training sector is still facing difficulties and obstacles as the commune-level education management team lacks expertise and experience.

Establish under the authority of the Commune Education Advisory Council; groups/teams of key educational institution managers to advise and support the implementation of educational and training activities at the commune level. Participants are educational managers, teachers who are working or retired, ensuring that there are no problems arising in the unit or administrative organization.

Assign the Department of Education and Training to recruit and mobilize teachers

The Ministry of Education and Training has also requested the Provincial People's Committee and the Chairman of the Provincial People's Committee to consider and decide on decentralization, authorization, and assignment to the Department of Education and Training to preside over the recruitment, reception, mobilization, secondment, and transfer of teachers and staff in educational institutions in the province.

Pursuant to Clause 10, Article 23 of the Law on Organization of Local Government, the duties and powers of the Chairman of the Commune People's Committee are "To direct and organize the recruitment, use and management of civil servants and public employees in the locality according to the provisions of law and decentralization of superior state agencies". Thus, the Chairman of the Commune People's Committee only carries out the recruitment and use of civil servants if decentralized.

“In the context that the number of commune-level civil servants in charge of education and training is currently lacking, and many of them do not have experience in state management of education, decentralization to the Department of Education and Training to preside over the recruitment, reception, mobilization, secondment, and transfer of teachers and staff in educational institutions in the province is appropriate to the current conditions and capacity of the Department of Education and Training,” the Ministry of Education and Training affirmed.

In addition, the assignment of the Department of Education and Training to take the lead in recruiting, receiving, mobilizing, seconding, and transferring teachers and staff ensures the implementation of the policy of reducing intermediaries, synchronizing recruitment quality (one-time recruitment can be registered for admission to many schools based on exam/examination results), saving costs, and increasing opportunities for recruitment participants. At the same time, it contributes to overcoming the situation of local surplus/shortage of teachers and staff as well as ensuring the structure of the team according to grade levels, subjects, and educational activities.
