The Department of Construction has just issued a draft decision regulating a number of contents on granting construction permits (GPXD) in Hue city.

Accordingly, the Department of Construction will issue construction permits for special and grade I projects in the city. Construction projects are located within the administrative boundaries of two or more commune-level units.

For the Management Board of the City's Economic and Industrial Zones, it will issue construction permits for projects located within the economic and industrial zones under its management.

In addition, the People's Committee at the commune level is assigned to grant construction permits for works of level II or lower, and individual houses (regardless of construction level) in the area under its management.

In case of conflict between criteria to determine the authority to grant construction permits, the Department of Construction shall be the agency to select the implementation plan and report to the City People's Committee for consideration and decision.

According to the Department of Construction, newly built individual houses and buildings are granted a limited-term construction permit, with a maximum height of 2 floors (no basement or semi-basement), a total height of no more than 10 meters and a total construction floor area of ​​no more than 160 square meters.

Construction works and individual houses that are repaired or renovated on a scale after repair or renovation must have a total height of no more than 10m and a total construction floor area of ​​no more than 160 m2. In case construction works and individual houses have a larger current scale, they are repaired or renovated and kept intact (no increase in construction area, total floor area, height, or number of floors).

A construction project granted a temporary construction permit shall exist until a decision is made to reclaim the land by a competent State agency. When the construction project expires or the State clears the land to implement the planning, the investor must demolish the entire construction project granted a temporary construction permit. If the investor fails to demolish it, it will be forced to do so and the investor must bear all costs for the enforcement.
