Does the Department of Education and Training have full authority to recruit, transfer and appoint teachers?

It is expected that the Department of Education and Training will be responsible for recruiting, managing, using, receiving, mobilizing, seconding, transferring, appointing... teachers in public educational institutions in the province.

The Ministry of Education and Training has just announced a draft circular guiding the functions, tasks, and powers of the Departments of Education and Training and the field of education and training of specialized departments under the People's Committees of communes and wards to collect comments.

7 tasks transferred to provincial level

Compared to the current document, this draft has many notable adjustments. Specifically, the Department of Education and Training is assigned to advise the Provincial People's Committee to perform 7 tasks under the authority of the Minister of Education and Training, now delegated to the Chairman of the Provincial People's Committee according to Decree 143/2025/ND-CP.

It is expected that the Department of Education and Training will be given the right to recruit, appoint, and transfer teachers in public educational institutions.

The tasks include: recognizing the province as meeting the standards for universal education at level 1 and level 2, eliminating illiteracy at level 1 for the province; allowing the establishment of preschool education facilities and general education facilities by foreign diplomatic missions and intergovernmental international organizations.

Converting preschool and general education facilities proposed to be established by foreign diplomatic missions and intergovernmental international organizations into non-profit facilities.

Approve the association to organize foreign language proficiency certification exams; issue, extend, amend and supplement decisions permitting the establishment of representative offices of foreign educational organizations and institutions in Vietnam.

The Department of Education and Training is also responsible for advising the Provincial People's Committee on granting, amending, supplementing, extending, re-granting, terminating operations, and revoking licenses to establish representative offices of foreign vocational training organizations and institutions in Vietnam; and assessing the assurance of conditions for organizing teaching of ethnic minority languages.

Notably, the Department of Education and Training is assigned all the tasks of recruitment, management, use, reception, mobilization, secondment, transfer, appointment, promotion of professional titles, change of professional titles, training, fostering, and evaluation of the team of teachers, management staff, civil servants and employees in all public educational institutions in the province according to the provisions of Decree No. 142/2025/ND-CP.

Previously, for preschool, primary and secondary schools, these tasks were performed by the District People's Committee and the Department of Education and Training.

Add 2 tasks for Chairman of People's Committee commune

The draft circular also specifically stipulates the advisory role of the specialized department on education and training under the commune-level cultural and social department in performing state management tasks on education for educational institutions in the area.

Notably, the draft has added two new tasks for the chairman of the People's Committee of the commune. Specifically, the chairman of the People's Committee at the commune level decides to recognize, appoint, re-appoint, extend the working period to retirement age, dismiss, resign from office, second, change job positions, reward and discipline the heads and deputy heads of public educational institutions under their management.

Second, the commune-level cultural and social department advises and submits to the commune People's Committee chairman the decision to establish a school council; recognize, appoint, and dismiss the school council chairman; and add and replace school council members at public educational institutions.

At the same time, advise on the decision to recognize or not recognize the school board, chairman, vice chairman of the school board, principal, and vice principal at private educational institutions in accordance with the title standards and legal procedures prescribed.

According to the Ministry of Education and Training, clearly defining the scope of consultation and limits of authority at the commune level is a necessary step to perfect the decentralization mechanism in education management, contributing to improving the effectiveness and efficiency of policy implementation at the grassroots level.
