In 2022, Achim Vina Co., Ltd. (100% Korean capital) implemented the Project of a factory for processing and preserving aquatic products, producing ready-made dishes and food, with a total investment of about 30 billion VND in Cong Hoa Industrial Park (Chi Linh). By 2023, this project will start operating and create jobs for over 30 workers with an income of about 6 million VND/person/month. Although it has been in production and business for a long time, Achim Vina Co., Ltd. has not yet established a trade union organization.
A representative of Achim Vina Co., Ltd. said that this was the first time the company had invested in Vietnam, so it did not fully understand the current regulations, especially the establishment of a trade union within the company. Currently, the company's production and business activities are still taking place on a small scale, so the number of employees is not large. In the coming time, the company will continue to improve its production capacity and attract more employees. It is requested that relevant units support the company in establishing a grassroots trade union.
According to a survey by the Provincial Federation of Labor, as of March 13, there were 174 enterprises with more than 11,000 workers in the province that did not have a trade union. Based on the survey results, trade unions at all levels in the province organized working sessions with enterprises and union members to mobilize the establishment of grassroots trade unions. However, by June, only 15/174 enterprises had established trade unions.

The reason is that many enterprises do not fully understand the purpose, meaning and effects of trade unions, so they deliberately avoid them. In addition, a number of workers in non-state enterprises do not really trust and are attached to trade unions. Policies to attract, train and protect trade union officials, especially non-professional trade union officials in enterprises, are still limited...
The lack of a trade union can lead to many negative consequences, not only for workers but also for businesses and society. The biggest problem is that workers are easily treated unfairly, their lives are not guaranteed, leading to strikes that disrupt production activities and affect the reputation of businesses. Workers' updates on policies and laws are limited, potentially leading to violations of the law, company rules and regulations.
According to Ms. Dang Thi Tuoi, President of the Hearty Rise Company Limited (Thanh Mien) Trade Union, the state encourages the establishment of trade unions to protect the legitimate rights and interests of workers. However, the Trade Union Law stipulates that trade unions are socio -political organizations established based on the voluntary spirit of the working class and laborers. With this provision, it is clear that the establishment of trade unions is not related to enterprises, although in labor relations, there must be an organization representing workers.
"For enterprises with trade unions, all rights of employees will be established and bound through collective labor agreements. As for enterprises that have not been established, the trade union at the higher level will be responsible for protecting the legitimate rights and interests of employees. However, I find this quite inappropriate because the trade union must be close to the employees to promptly grasp their thoughts and aspirations," said Ms. Tuoi.
Actively promote and mobilize
Since the beginning of the year, the Thanh Ha District Labor Federation has developed nearly 900 union members and 5 grassroots unions, achieving 87% of the assigned target. This is a typical unit of the province in mobilizing union members to participate in trade union organizations and establish grassroots unions. According to Mr. Le Dinh Diem, Chairman of the Thanh Ha District Labor Federation, to establish a grassroots union, it is necessary to first innovate the way of propaganda, mobilization, and gathering union members. Instead of sending official dispatches, unions at all levels need to approach union members through regular meetings or organize welfare programs. The union organization must affirm its core role of protecting the rights and taking care of the lives of workers.

"With the motto that wherever there are workers in difficulty, there is a union, we have carried out many social security activities for workers. In addition, we have strengthened our close contact with the grassroots, proactively grasped the aspirations of workers to have timely solutions. Thanks to that, over the years, the work of developing union members and establishing grassroots unions in Thanh Ha has always exceeded the set plan," said Mr. Diem.

In the first 6 months of the year, the provincial trade unions at all levels have developed over 9,000 union members and established 33 grassroots unions. To achieve the above results, the Provincial Labor Federation has resolutely implemented many solutions to build a strong union organization. The unit has proactively developed a coordination regulation with all levels and sectors to regularly and promptly update labor information. Annually, conduct surveys at enterprises without a union organization to develop appropriate propaganda and mobilization plans. Assign specific targets to the grassroots trade unions directly above the grassroots level on the work of developing union members and establishing grassroots unions.

Mr. Nguyen Van Quyet, Vice Chairman of the Provincial Labor Federation, said that in the coming time, the Provincial Labor Federation will continue to organize working sessions with business owners to support and help units facing difficulties in developing union members and establishing unions.
