Amended Advertising Law tightens responsibility of celebrities

The National Assembly has just officially passed the amended and supplemented Advertising Law (effective from January 1, 2026) with regulations tightening the responsibilities of celebrities, including artists, when participating in advertising.

Talking to Thanh Nien reporter , lawyer Le Trung Phat, Director of Le Trung Phat Law Firm (HCMC), said that for a long time, celebrities and artists have had a huge income from participating in advertising. Their influence has a big impact on viewers' decisions to buy the products and services they advertise. However, the law has not previously clearly defined their responsibilities when participating in advertising. When the Advertising Law 2025 takes effect from January 1, 2026, this responsibility has been mentioned. Celebrities must verify the credibility of the person who wants to advertise, check the documents of the product or service. In case they have not used or do not clearly understand the product, they are not allowed to advertise that product.

"With such clearer regulations, it is also the basis for determining violations by celebrities. Then, when they violate, they will be handled according to the provisions of the law. If the violation is determined to be minor, the act of false advertising can be subject to administrative sanctions, the fine can be from 60 to 80 million VND according to the provisions of Article 34 of Decree 38/2021. In case the competent authority determines that there are signs of a crime, the person who commits the act of false advertising can be prosecuted under Article 197 for "crime of false advertising" or Article 198 for "crime of deceiving customers". The specific penalty will be based on the determined violation," Mr. Le Trung Phat clearly stated.

It can be seen that the revised Advertising Law will not make it easy for artists to advertise for a brand or organization, but will tighten the artists' sense of responsibility for the products they advertise, helping to strengthen the audience's trust in artists, helping them maintain their reputation and image, and at the same time avoid legal problems when being punished or prosecuted for criminal cases if they violate the law.

"The new regulations of the Advertising Law will also be a tool to eliminate dirty advertising on social networking platforms, chaotic advertising activities, snatching, regardless of the consequences that have existed for a long time. It is the door that opens and protects those who do business legally, protects consumers. The advertising market may stagnate for a short time, but it is a stepping stone to arrange, reorganize, and develop more than before, on the general development of science and technology, artificial intelligence and a transparent legal system," said lawyer Le Trung Phat.
