"There is a mechanism of exemption from liability, considering scientific research risks as tuition fees"

On the morning of February 15, the National Assembly discussed in groups the draft Resolution of the National Assembly on piloting a number of policies to remove obstacles in science , technology and innovation activities.

Speaking at the meeting, Prime Minister Pham Minh Chinh emphasized that if the country wants to develop quickly and sustainably, it must rely on science, technology, innovation, and digital transformation; this is an objective requirement.

According to the Prime Minister, along with Resolution 57-NQ/TW on breakthroughs in science, technology, innovation and national digital transformation of the Politburo , it is very necessary and urgent for the National Assembly to have this resolution to remove current difficulties and obstacles to put the resolution into practice.

Although the proposed mechanisms do not cover all issues, the Prime Minister said that the Government will discuss and give opinions to comprehensively amend related laws and add many specific contents to create comprehensive innovation.

These laws include the Budget Law, Tax Law, Enterprise Law, Science and Technology Law and a number of other related laws. The Government is focusing on directing amendments and at the latest this year, a number of laws can be presented at the National Assembly session in May.

According to the Prime Minister, it is necessary to research more special mechanisms focusing on infrastructure development, science and technology, innovation and digital transformation.

Since infrastructure is still weak and requires large resources to be mobilized, there needs to be public-private partnership resources from businesses, society and people to develop infrastructure.

In addition, the Prime Minister said that a special mechanism is needed for management, including mechanisms such as public leadership, private administration; public investment, private management; private investment and public use.

For example, the State invests in science and technology infrastructure but hands it over to the private sector for management; or public leaders design policies, laws, and monitoring and inspection tools, but administration is handed over to businesses, the Prime Minister gave an example.

In addition, the Prime Minister also said that there should be a special mechanism for scientists and commercialized scientific works, including procedures, decentralization of authority to relevant entities, elimination of the request-grant mechanism, reduction of administrative procedures, and overall effective management.

In particular, the issue of exemption from responsibility for the implementer is considered by the Prime Minister to be a difficult issue and a weak link.

"If there is no protection mechanism, the person doing the work will be afraid of responsibility, will move from one place to another, and will not want to do it because they are not protected," Mr. Chinh stated the reality.

Therefore, it is necessary to design an additional mechanism to exempt liability when risks occur for both implementers and policy designers, according to the Prime Minister.

Regarding the special mechanism to attract human resources, Mr. Chinh said that there will be a mechanism to attract workers outside the state sector, private enterprises, and foreign human resources. The policies will include taxes, fees, charges, housing, land, visas, and labor contracts.

The Prime Minister also emphasized that policy design must take care to avoid corruption and negativity, and must have special tools for management and transparency.

Besides, the Prime Minister also said that it is necessary to accept risks and delays in scientific research; because there are breakthroughs that can be successful but there are also failures that must be accepted and paid for.

It is necessary to consider it as tuition fees, investment in training resources to have appropriate policies; it is necessary to eliminate personal motives, not for profit but must be impartial, transparent, for the common benefit of the country, according to the Prime Minister.
