Implementing the policy of building Ho Chi Minh City Ring Road 4

The Government has decided to implement the Ho Chi Minh City Ring Road 4 Construction Investment Project (the Project) for which the National Assembly decided on investment policy in Resolution No. 220/2025/QH15 dated June 27, 2025, ensuring compliance with legal regulations, progress, construction quality, strict management and economical, effective, public and transparent use of capital. Specifically:

Group of investment components in the form of public investment: Chairman of the People's Committee of Ho Chi Minh City and Chairman of the People's Committees of Dong Nai and Tay Ninh provinces exercise the authority of the investment decision maker, organize the preparation and appraisal of the Feasibility Study Report and decide to approve the project.

The order, procedures, authority to appraise and decide on investment in component projects are implemented similarly to those for group A projects according to the provisions of law on public investment.

Component project groups implemented under the public-private partnership method: Ho Chi Minh City People's Committee and the People's Committees of Dong Nai and Tay Ninh provinces organize appraisal and approval of component projects according to the provisions of the Law on Investment under the public-private partnership method.

The management and use of state budget capital to support the construction of works and infrastructure systems arranged from public investment capital sources in component projects implemented under the public-private partnership method shall be carried out in accordance with the provisions of Clause 5, Article 70 of the Law on Investment under the public-private partnership method.

The order, procedures, and authority for appraisal and approval of appraisal results of environmental impact assessment reports of component projects shall comply with the provisions of Decree No. 136/2025/ND-CP of the Government and provisions of law on environmental protection.

The Resolution clearly states that the Chairman of the People's Committee of Ho Chi Minh City and the Chairman of the People's Committees of Dong Nai and Tay Ninh provinces and the heads of competent agencies shall apply the form of designated bidding in the process of implementing the Project for consulting, non-consulting, consulting packages for planning adjustment and construction of infrastructure for resettlement areas. The order and procedures for implementing designated bidding shall comply with the provisions of the law on bidding.

For the exploitation of group IV mineral mines and minerals used as common construction materials belonging to group III minerals according to the provisions of the Law on Geology and Minerals serving the Project, the mechanisms in Resolution No. 220/2025/QH15 dated June 27, 2025 of the National Assembly shall be applied.

After exploiting enough minerals to supply the Project, the contractor is responsible for performing the obligation to renovate and restore the environment, hand over the mineral mine and land to the locality for management in accordance with the law on minerals and other relevant laws...

The Resolution assigns specific tasks to a number of Ministries and sectors for implementation. In particular, the Ministry of Finance guides and resolves within its authority or advises competent authorities to resolve difficulties and problems (if any) related to the selection of contractors and investors to implement the Project and issues related to the specialized fields in charge.

Based on the balancing capacity of the central budget, the Ministry of Finance shall preside over and coordinate with competent authorities to consider and decide on the arrangement of medium-term public investment plans, and annually supplement the central budget with targeted funds for local budgets to implement projects in accordance with the provisions of the law on state budget, public investment and relevant laws...

The Ministry of Agriculture and Environment shall preside over and coordinate with relevant ministries, branches and localities to issue documents guiding localities and construction contractors on the implementation of the special mechanism on mineral mining for common construction materials prescribed in Clause 1, Article 3 of Resolution No. 220/2025/QH15 in case of any problems arising under its authority.

Preside over the guidance, resolve within the authority or advise competent authorities to remove difficulties and problems arising (if any) in the work of recovery, compensation, support, resettlement, work related to environmental impact assessment, work of mining minerals for common construction materials serving the Project and issues related to the specialized field in charge according to the provisions of law....

The Ministry of Construction guides, resolves within its authority or advises the Government and the Prime Minister to remove difficulties and problems related to project management, cost management, construction norms, construction materials, construction quality management, construction contracts and issues related to the specialized fields under its charge; guides localities to announce prices of common construction materials in accordance with legal regulations; guides the determination of prices of materials exploited at mines according to the mechanism in Resolution No. 220/2025/QH15...

The Ministry of National Defense directed Military Region 7 to support the People's Committee of Ho Chi Minh City, the People's Committees of Tay Ninh and Dong Nai provinces to resolve issues related to national defense according to the opinions of the Ministry of National Defense; directed units to urgently carry out the work of clearing bombs, mines and explosives to ensure the progress of handing over the project site.

The Ministry of Public Security directs its affiliated units to support the People's Committee of Ho Chi Minh City, the People's Committees of Tay Ninh and Dong Nai provinces in site clearance, ensuring security and order; and carrying out design approval and acceptance of fire prevention and fighting for works and construction items according to the law.

The Ministry of Industry and Trade , the Ministry of Science and Technology, and the Ministry of National Defense shall coordinate with the People's Committee of Ho Chi Minh City and the People's Committees of Dong Nai and Tay Ninh provinces to direct their affiliated units to urgently relocate technical infrastructure works under their management to ensure the progress of site handover as required in this Resolution...
